Advice on HSMP FLR-IED application in view of the new rules

I am an Indian national working in the UK on a work permit. I have recently applied for HSMP which was approved. I have the following 2 questions regarding my FLR_IED for your perusal:

1. I understand that if I were to apply for FLR-IED prior to 3rd April 2006, I would be granted FLR which is valid for 1 year --OR-- if I were to apply for FLR-IED post 3rd April 2006, I would be granted a 2 year FLR.

Is my understanding correct, as I would be completing my 5 years for ILR in Aug 2007 (my ILR was due in Aug 2006 until the new legislation - doh!) and a 2 year FLR would save me a small fortune.

2. I have found a new job, which I need to join asap. Would I be on the wrong side of the fence if I were to take up this job before I am issued FLR for HSMP (FLR for my current work permit is valid until next year).

That is also my understanding.

I think not just you "on the wrong side of the fence" but also your new employer. That employer faces prosecution and a £5000 fine.

When are you hoping to start this new job?

I conveyed to my prospective employer the impression that I can join by end of this month and they have made arrangements to send me on a course in April 1st week. Now, if it is illegal, then I might have to bite the bullet and just go for a 1 year FLR. I would be really grateful for:
- any indications on how much time it takes the Home Office to issue me a FLR
- and any advice on expediting my FLR so that I can still join my new job in the last week of March.
