Advice - living in the UK (EEA National & UK Citizen)

Summary

so I have a few questions relating to immigration and rights to live in the UK.

I was born and live in the UK British citizen, I have a Finnish wife who currently live in Finland but travels here regularly. we plan to have children some time soon so she is looking to come live here.

Being an EEA national would she need a visa? if so which?

the plan when she come here would be for me to be working and her to be the "homemaker" would this change anything?

also as we plan to have a family would her healthcare be covered by the NHS?

any help will be greatly received

All EEA and Swiss nationals can enter and live in the UK without needing to apply for our permission.

I previously read the page you have linked. Which is the working in the UK EEA page and wasn't sure if these apply in the situation I stated.

Would the working in the UK EEA guidelines still apply? as technically she wouldn't be working but in Effect a stay at home Partner/Mum

What guidelines are you talking about? Didnt get that...

Yes, even if she is not working she still has a right to live in the UK, if she wants a confirmation she can apply for EEA1(not required) and later if she wants to apply for permanent resident of UK she could apply EEA3 and for that

UKBA states

If you are economically self-sufficient, you need to supply evidence of comprehensive sickness insurance and funds sufficient to maintain yourself and any family members included in your application during the time you intend to reside on this basis. These funds can come from the employment or self-employment of any of your family members legally working and residing in the UK with you. Documentary evidence of their employment or funds should be supplied.

this is not for working, but living in the UK

Under European law, you do not need to obtain documentation confirming your right of residence in the UK if you are a national of a country in the EEA.

so the basically I read from that link was that if you an EEA national that is not one the slightly control country's you can live in the UK as long as you dont become a burden on public funds.

So another question, If we do plan to have a family, as a working family I would become entitled to Working/child tax credits & child benefit, By claiming these would this be considered a burden on public funds?

Also medical care care would be given as long as she can prove she is currently residing in the UK?

I realise I'm asking question which would probably be better in another sub forum but I dont wish to open multiple threads on one topic.

If YOU are claiming all that then there is no burden on public funds since ur a UK Citizen and you have the right too, but if you want more opinions regarding your wife as an EEA claiming all that, continue below

Also if you stay out of UK for 3months or more then NHS (Hospital Services) are discontinued, I believe they were going to change it to 6months now.

To gain back you would have to live here for 6months again...

aren't tax credits claimed as a joint claim and so she'd have to go on the paper work?

Have you lived together with your wife outside of the UK? Were you married and working then?

Are you working in the UK now?

When is she thinking, roughly, of coming to the UK?

In general I think you will find very few problems, if any. She can work if she wants. And can register at a local GP.

It seems to me this whole tread is a non-issue. Finnish nationals can (like any other EU citizen except from A2 countries) come to live and work in the UK as they please without any formalities whatsoever (except the formalities that British people also have to comply with, like getting a NI number, etc.).

A valid passport is the only document you normally need to claim your rights under European law.

Only when you want to bring non-EEA family members, it may be worthwhile to consider to apply for a Registration Certificate, and of course after five years in the UK apply for confirmation of Permanent Residence.

Whilst i largely agree, and of course the wife can come here without restrictions, if she wants to eventually settle here she needs to be exercising her treaty rights. The op states their plan is for his wife to be the 'homemaker'. In this scenario it may be wise for the wife to get comprehensive sickness insurance whilst she is not working so she can prove her self sufficiency should she apply for permanent residence in 5 years time.

EU citizens have it easy. They will rarely be asked details of what they are doing at the airport, and never really have to apply for anything from UKBA. Only if they want to apply for British citizenship would they have to provide any details of what they have been doing.

So from a practical point of view, the EU citizen would not need to be working or have private medical insurance. They could just register with their local Doctor and get on with life.
