Advice Needed (Citizenship: Stateless Vs. Jordanian)

Post by ranihasan » Sun Apr 09, 2006 2:40 pm

I’m on the verge of making one of the important decisions in my life, and I need your advice. (Sorry for bugging you, as this is my second post asking the same question)

First of all the facts:

- I’m planning to lodge and immigration application as a Skilled Independent Worker. (I’m the primary applicant)
- I was assessed by ACS as a Suitable IT Professional, with 5.4 years of experience.
- I undertook IELTS exam and scored an 8 Band on all four sections.
- I would score 125 Points on the Points Test (120 is the current Pass-Mark)
- I’m married (2.5 years) with no kids, and no pregnancy in the foreseen future.
- I’m a Jordanian Citizen.
- My wife is a Palestinian, and is legally described as “Stateless”, with a valid special Jordanian passport that is used as a travel document and doesn’t constitute citizenship. (So my wife’s Citizenship is Stateless, and Nationality is Palestinian)

Second, the forthcoming events:

After five months (Sept 2006) my wife will get the Jordanian Citizenship (because she’s married to a Jordanian for three years), consequently her citizenship statues will change from “Stateless” to “Jordanian”

Third, the dilemma:

I’m afraid that the Australian Immigration Policy would be complex when it comes to granting Permanent Residency Visa (For Immigration Purposes), and thus my chances for getting a refusal on my application would be high. (Higher than normal because of such complexities).

Finally, the question:

Is it true that lodging an Immigration Application for someone whose spouse citizenship is “Stateless” would be more likely to be refused as opposed to lodging an Immigration Application for someone whose spouse citizenship from a well known country such as Jordan?

As for the options which I’m considering, and I also need advise on:

Option 1: Submit my Immigration Application now, and refrain my wife from getting the Jordanian Citizenship UNTIL the PR VISA is granted.

Option 2: Submit my Immigration Application now, and after FIVE months have my wife claim her Jordanian Citizenship, and then submit a “Change of Circumstances” for with all the relative information and changes. (Certify copies of passport and all changes documents)

Option 3: Wait FIVE months UNTIL my wife gets her Jordanian Citizenship and then apply (The Huge Risk would be if rules and regulations are changed, and I can no longer be suitable for Immigration)

Thanks for your time, and your anticipated input, for both the question and the option you think I should take.

Regards,
