Advice pls, what form do i need after getting married

Post by lola56uk » Mon Feb 01, 2010 7:05 am

About to get married soon and wanted to know what formi will need to use to regularize my stay.

Brief background, i am an overstayer applied for COA to get married. i have been with partner for 7 year plus and been in UKfor 16 yrs plus now. HO has been pushing me about for the last 2 years and have not approved application based on 14 year rule.

Needed COA as my girlfriend is British, but don't know what form to use to fill out once we are married.

Thanks in Advance .........

Form to use? I think none! That is, just wait for the 14-year application for ILR to be granted.

If you did make an application shortly after the marriage it would be for "just" a 2-year spouse visa, and near the end of that you would be applying for ILR.

14-year ILR applications do take 1 to 2 years to be dealt with. Hopefully you will hear soon.

Is it dangerous to go back to your home country and apply from there for a spousal visa? I'm afraid you can't just regularize ur stay just by getting married and filling out some paperwork. The home office is not that kind.

I guess if you want to give it a try it would be the flr(m). I'm not sure it would go too well though.
I tell it like it is.

Thanks Guys for the info.

I have been entitled to the 14 year visa roughly 4 years ago , it took home office 2 years to tell me the form had changed and they could not deal with my application. furthermore i submitted a new application thru MP and they wrote to him recently that they will not be looking at the application until 2014.

Now thats a very long time , like other members i am just wasting my youth away , no job , no papers to work and sign on monthly.

so even when i get married , i can not apply for any Visa over here and i will have to go back home, very risky as i have not been back home in over 18 yrs now and would be a stranger in my own land. Amazing !!!!!!!!!!

The HO is truly a competent government organization.

I am sure if you hadn't tried to circumvent the law and overstay then they may have been more competant

Thanks - but i was not trying to avoid the law , i came into this country with my aunt when i was 4. its not my fault that i am in this mess and its not hers too. i am sure she did not intend me to be an overtstayer when we initially arrived. you know i did not wish this upon myself and did not realise my situation until i was much older and wanted to go on holiday with my college or university friends.

So i think before we assume or attain certain reasons why different users or people might have overstayed we should ask or wait till they provide more info.

Can you say what country you are from please?
they wrote to him recently that they will not be looking at the application until 2014.
Any stated reason for that? Are they suggesting that there was no proof of you being in the UK before 2000? Just wondering why UKBA will not look at the current ILR application for 4 years?
