Advise on sponsoring spouse from Srilankan to UK

Post by Vasi » Thu Aug 15, 2013 11:47 am

Hi Guys

I am UK residence guy live and work full time, i am looking to get married to a girl who lives in Srilanka.

She has got her visa refused previously on following grounds.

“You have applied for an entry clearance for Family Reunion in the United Kingdom.”

“The Immigration Judge directed us to reconsider your application under paragraph 352D of the Immigration Rules and indicated that we had to pay particular attention to any compelling and compassionate circumstances that you may be living under in Sri Lanka.”

“The office traced your employer through your NIC number. We then contacted them on Friday 12 August and again on Monday 15 August and they confirmed your employment.”

“You have been employed and earning a salary since 2005 when you were 21 years old. You have attempted to mislead us by failing to declare your employment circumstances both on your visa application form and at interview on 15th August 2011. I therefore consider that you have attempted to frustrate the Immigration Rules of the United kingdom by not being truthful and as such your application is also refused under paragraph 320 (7A) and 320 (11)."

I need some advice on is there anyway after marriage i could apply for her to join me in UK after this refusal? or is it something very hard to do and wait for a long time?

Many thanks in advance.

Br

You're going to need legal advice on this. Your problem is the inclusion of 320(11)- 'aggravating circumstances' which brings a ban into force even if you marry.

Moreover, it's not specified how long a refusal based on 320(11) may last.
