After Finally refuse -what other options for me to choose ?

After Finally refuse -what other options for me to choose ?

Me ,my wife are living in UK for last 9 years and we have a 1 old daughter.I was a student ,my wife was my dependent.last year we applied for leave to remain visa under article 8 and it was refused.we are waiting for appeal hearing next month.

If we finally loose in appeal then what other option is open for us to live another 1 year legally without being over stayer ? I heard that Tribunal will give us 28 days to decide to leave this country or applied another visa ? can we applied for student visa or work visa ?

It's not tribunal who gives u 28 days .

When u will receive your last court determination than after that u consider as an overstayer.

u can apply a new visa during 28 days time as this time won't effect your future application.

many thanks for your information. in future if I applied for ILR those 28 days could create problem.?

I came in UK in 31st August 2005 as student, my wife as my depended. We have a 16 month old daughter. We applied for further leave to remain on last June 2013 on article 8 on a medical ground. Our visa was refused and appeal was dismissed aswel on first week of July 2014.Now we are waiting for reissue our decision’s letter because this letter was sent into my old solicitor’s address. Tribunal are saying they have a backlog in their system, so they will take time to send it.
Next year 31th August (another 12 month) will be my 10 years for applying ILR.My question is…..
We will appeal in Upper tribunal then if possible appeal in court of appeal. When all those appeal process finished and if we are still unsuccessful then ….
1.what could be other option to live lawfully in UK for qualify applying for ILR ?
2. if I don’t have leave to remain can I able to apply for ILR from 28 days before my 10 year period complete ?
I would be very very pleased if you could give me those information. If you need any information please let me know.

Very hard for u to kill 12 months o remaining appeals time (UT and COA).U can go to COA once u get Permission in UT.

I am short of 7 months from now i am waiting for FTT hearing date i am not sure whether i can make it or not.

U should prepare yourself for a new application when u exhaust all appeal rights.
