All spouse visa problems in one???

Post by rozc » Tue Nov 15, 2011 3:43 pm

Frst of all i would like to say hello to everyone on here and hope that the questions i ask are not stupid.

Ok - my 'story' is as follows - married an Egyptian national over 5 years ago and stayed in Egypt (and we are still together....lol). Now i have some health problems (heart) and want to go back to UK, - I am a British Citizen born and bred -and am 60 years young. My problems are - that when I left the UK i gave up everything - home, job, car etc... and have no accommodation of my own or income, except for my pension. I know - just please don't say it. I have friends who have said they will let me stay with them (and my hubby if he can get his visa)- rent free - (until we can get established) - they have also said they will lend me a substantial amount of money (which can be paid back at a later time) so that we are not on benefits - and the husband of my friend has said that he can get my hubby an interview for a job - can anyone give me advice/suggestions regarding their knowledge of the spouse visa please.

Thanks

John

As long as the application is accompanied by good supporting evidence I see no reason why the application for a spouse visa should be refused.

Also, given the two of you have been married for 4+ years, when the application goes in, put in a covering letter that the visa should be issued with the endorsement "KOL REQ". The advantage of this is that after your husband gets to the UK, then studies and hopefully passes the Life in the UK Citizenship test, he can then apply for ILR without delay, that is, without needing to wait until near the end of the spouse visa.

Thanks John for your quick reply - we didn't know about asking for ILR, so that was a nice surprise; and you really think that living with friends and borrowing from them will not be a problem - i hope so. :D

Not quite, you point out to them that the 27-month spouse visa should have the "KOL REQ" endorsement.

With that endorsement ILR can be applied for in the UK as soon as the Life in the UK Citizenship test has been passed.

For those that cannot get the "KOL REQ" endorsement, the ILR cannot be applied for until nearly two years in the UK, even if the Citizenship test is passed rapidly.
