Dear Friends

I got a letter from Tribunal Services Immigration & Asylum about an appeal which i made in Oct 2009 on behalf of my mom (Visitors Visa for 2 years)..

In that letter the judge agreed with my mom's answers and explaniation to the refusal in the appeal and he(the judge) used the term appeal allowed? what does it means?

now please tell me what happens next ..does the Home office will apply against the decision to the Upper Tribunal?

and when would my mom get a visa on her passport.

It means your mum has won the case ( appeal allowed) at the hearing. The HO have a right to appeal against that decision if there was an err in the law.

However this very rarely happens. The same decision that you got will be also send to the post where your mum applied, so they can start the process of asking your mum to hand in her passport to them, to stamp the visa to allow her to travel to the UK.

Depending on where your mum lives will depend on how quickly they can do above. In some countries it can take a matter of 4 weeks to 5 months .

just remember when they ask your mum when she intends to travel, she can post date the visa if she wants ( For example if you want her here for Xmas then delay her visa for 3 months (max), so its starts in August and expires in Jan/Feb)

If on the other hand you want her to come straightaway then ask visa to start immediately.

Remember the max she can stay is 6 months, after which she has to return to her homeland.

that is a very good news..

My moms application was for 2 years visitor visa, so is she going to get 2 years visa or 6months?

the application was made in pakistan so how long does it usually takes there?

We had another appeal against HO as we made two applications in few months ..so what will happen to the other appeal?

She will still only get 6 months not two years. Once she has been to this country several times, she may be in a position to apply for a 2yrs multiple visa.

The bad news is that in Pakistan it is taking up to 4-5 months to get the visa stamped because of the big backlog they are dealing with.

What was your second appeal for?. If it was for the same thing, then I suggest you contact both HO and AIT and say you want to withdraw the second appeal. If it has nothing to do with this then let the second one continue

No she's bin here in UK on a six month visa in past and stayed for 3 months and went back home ...
Its really bad news that it would take so long to get the visa from Pakistan.. Last time we applied in pakistan but application was processed in dubai as Pak High commission was closed for security reasons..

The second appeal was also for a visitor visa which we applied after first rejection..

Is there any way we can get the visa quickly?i mean by calling HO or something?

We don't want to withdraw the second appeal until we get the visa..

She will still get issued with a six months visa irrespective of the fact that she has been here once before. To get multiple visa the ECO need to be sure that she normally returns back home. To do this you need to show that she has done at least 3-4 times in the last few years

Its really bad news that it would take so long to get the visa from Pakistan.. Last time we applied in pakistan but application was processed in dubai as Pak High commission was closed for security reasons..

It is still the same position as then, but just taking a bit longer

No except join the other hundreds of people in the queue who usually try writting, emailing and telephoning them. There is a seperate post here somewhere specifically for this. have a read of that to get better ideas

Why dont you want to withdraw it, you have won your appeal and you will be issued with a visa sooner or later....... I think there is a possibility that it might be automatically withdrawn without your knowledge if it was for the same matter

Bro it took 2 years to get to this point ....can't we claim to HO that we paid the extra fee for 2 years visa....as after this six months we have to wait even longer to get another 6 months visa..

Also should i contact the dubai office to request the call letter?

and should i involve my MP in this process to fasten it up?
