Appeal against refusal for my wifes visitor visa

Post by TKDLITE » Thu Jul 07, 2011 3:48 pm

Hi All

I am new to this and I may be posting this incorrectly.

My wife had a visitor visa for 6 months and came to UK twice but when we applied second time for 1 years visa it was refused as she is a student in Turkey and ECO said that how can she stay here too long when she is a student in Turkey.

We have now appealed and lodged the appeal on the 8th April and emailed to tribunal to have the court case asap as my wife is now pregnant and she will give birth in September. But I still have not heard anything back from them.

Any ideas how to proceed to make sure the case is heard asap?

Thanks

Your wife can not have a baby in the UK on a visitors visa.

She can if you are willing to pay for it whilst she is admitted into hospital to have it.

That is providing she gets the visa in the first place, which seem highly unlikely in what you have stated above

In fairness to the OP - he doesn't say that he wants his wife to give birth here - merely that they want to visit and that the baby means they have to rush.

I would suggest to the OP that most Stupid will not let someone fly beyond 36 weeks.

If you wife is due in September - she will hit that marker at second week August at the earliest and end August at the latest.

EVEN if the appeal tribunal was heard in the next couple of weeks, there would then be a delay in getting the visa issued, which would almost certainly overrun the first date, if not the second - making travel impossible.

And even if the visa was issued, then the return would either have to be scheduled before 36 weeks, or you'd have to be prepared to open your wallet for the birth.

An example of the cost: http://www.walletpop.co.uk/2011/01/17/b ... g-you-off/

This is 9 years ago - and the cost of the birth was nearly £5,000. You can expect it to have risen considerably since then. Any unpaid bill could easily result in further refusals.

So - to be honest - I'd suggest it would be sensible to forget the current visa quest prior to birth, focus on getting a healthy, safe, baby in Turkey and you head there for it.

The issue isn't the fact that the OP's wife is pregnant, but that she was refused entry clearance as there is no compelling evidence that she will return to Turkey to study. As studying is seen as a temporary migration route by the UK, I think the OP will have a hard time convincing an ECO that she will come to the UK and then return to Turkey to continue her studies (especially in light of the fact that she is pregnant - it could be argued that she is less likely that she will continue her studies and that she will need some sort of support structure).

To the OP: you need to find a way to convince anyone looking at your application that your wife has a really good reason to go back to Turkey after her visit is complete. I do not see an easy way out of this one...
