Appeal Allowed, Can I Work?

Appeal Allowed, Can I Work?

Hi, my partner and I received a successful court decision on 27th August "under the immigration rules, and alternatively on human rights grounds". We got our court fee back, and we are now waiting for the visa and passport documents. I know this can take 12 weeks or more, but I have received a job offer and the employer is asking for proof that I can work (e.g. a passport).

I am wondering if I can start working straight away, if I show the employer the allowed appeal and give them my NI number. I was previously on a student visa, which limited me to 10 hours of work a week - I applied for the spouse visa before that student visa expired, but it has since expired, so I assume at the very least I am allowed to continue working 10 hours a week under the previous visa rules? But I'm hoping that there's something to say if an appeal has been allowed and you are waiting for documents, that you can start work..

So option 1 - I can't work at all until I receive my passport and new visa documents.
Option 2 - I can continue working 10 hours a week, per my previous student visa that was active when I applied for the spousal visa (and then had to go through appeals process).
Option 3 - I can work freely, as my appeal has been allowed and the documents are on their way. If this is the case, what proof do you think I could show? The court decision letter and my NI number from my student visa?

Your Section 3C right continues until the matter is decided.

So at the very least, you are entitled to 10hrs employment.

Hi Harry,

I've been following your posts and I was wondering if you'd be open to sending me the cover letter you wrote for your appeal? My partner and I are almost in the same circumstances (FLR(M) refused with the right to appeal under Article 8) with a relationship that would not be recognised in my home country.

It would really help us out. Feel free to delete any info you feel is too personal. Just the content would be really helpful!
