appeal period can i made a fresh application

i have a problem, my husband application was rejected now i got hearing date as well, but i want to make a fresh application , i haven't no idea, anybody can advice me pls

In circumstances where section 3C is in play, you cannot make an application whiles an appeal is pending.

thanks for your advice ,i ll explain my situation. he is in outside uk, my husband application was rejected for about my visa. that period i was applied for extension. but when he first applied i got visa for 3 months. so now i got visa but still they not overturn their decision. now i got hearing date. i wait nearly 2 years. i cant wait anymore. my hearing date another 6 month later. so that's why i want to made fresh application for him.
