Appeal right exhausted, Urgent help required!!!!!!!!!!!!

I came to the UK on a 2 year HSMP visa since Jan 08, my wife joined as a dependant in early 09. We applied for 3 year extension to Tier 1 but was refused based because income short by 90pounds. LTR expired over a year ago. Appeal did not go through and right of appeal exhausted since the last 3 months. We now have a month old baby. Our MP wrote HO but they refused us and said we should regularise on different category or leave UK ASAP.

What can I do as I want my family to remain in UK especially for the sake and future well-being of our baby. Which category can we apply? I have been law abiding and have not committed any crime. Have now lived here 3 years plus.

Please I nee your advise.

Why can't you, your spouse and your child have a life of "well-being" in your home country?

Unfortunately, you are now an overstayer and presently "in breach" of immigration law. The more you stay illegally in the UK, the more difficult it will be to return to UK to visit / live / work, should the opportunity arise again in the future.

Do note that your child seems to have been born in the UK when neither parents had any valid leave to remain in the UK (appeal exhausted 3 months ago, child born a month ago).

Thank you for your advise. The problem is that standard of living and economic situation in my home country is bad and it will extremely difficult to survive especially with the child's up bringing.

with out valid visa life here wont be that easy. I don't think HO will change there mind just because you have baby. I guess if your wife or you qualify and want to learn change it to student visa.
