Appeal - waiting 2 months - good or bad sign?

Post by KHNW2 » Thu Oct 29, 2009 3:35 pm

Just wanted to know what the forum people think about this situtation - got refused a settlement visa and appealed in the country. Went to AIT on 14 August, the hearing went well, although difficult to say. So far no reply, neither yes or no, 2 months + since the hearing. Don't want to pester them but statutory guideline is 2 weeks for a decision. Shall I interpret it as a good sign that the judge is taking a while or is he just being kind and letting us enjoy one another's company a little longer before ordering to boot us out of the UK? Please share your thoughts.

Have you checked with your solicitor or that they have your current address? I've never ever seen anything like that. Two weeks is usually the norm.

I think you should ring and find out.

Normally you get notification from AIT ten days after appeal is heard. That same decision is sent by the HO to the post where you applied by internal post ( takes min 6 weeks).

Then the ECM at the post has to review decsion and then grant visa. It can easily take more than 2 months to issue the visa.

If its any consilation to you ,its taking on average 5 months in Pakistan to get the visa stamped in the passport after the appeal is won.however this is an exception and normally it takes on average 2- 3months.

Hope this helps

Received a decision today after nearly 3 months wait, with apologies for delay "due to absense". I am not complaining though as it is a positive one!!!! I simpathise with 5 months wait for a visa in Pakistan, however, it is not relevant to us as we are in UK at the moment and applied in country. Just fingers crossed UKBA doesn't decide to appeal!
