Is my application date correct?

Post by BaliOli » Sat Jul 27, 2024 9:28 pm

Hi everyone

I think I am right but it would be helpful if some of you savvy community members can help confirm….

I have applied for ILR via the 5 year family visa route (spousal). I am aware I can apply 28 days before I reach the 5 year anniversary.

First spousal visa approved on 6 August 2019
Second spousal visa (extension) approved on 28 January 2022
Second spousal visa expires 28 August 2024

This means the earliest I can apply is 8 July 2024? As that would be 28 days before the required 60 months of continuous living in the UK on the family visa?

This is what this calculator is saying anyhow… https://immigrationstory.uk/en-gb/tools/ilr-calculator

Many thanks!

Was your first spouse visa applied from outside UK? If yes, when was your first date of entry onto UK using the spouse visa as your 5year count starts from entry date.

If no, I.e. you switched to spouse visa within UK, it means you became eligible to apply for ILR since 09 July, 2024.

I was already in the Uk (transferred from a tier 2 working holiday visa at the time). So technically “arrived/entered” on the same day it was granted.

Going by your response, you are correct.
