Application for stay in UK as partner

Post by alvinhy » Tue Oct 28, 2014 10:56 am

Hello,

I would like to get some advice regarding my situation to confirm I am on the right direction.
Here is the current situation:

I am a british citizen with UK passport and would wish to apply a visa for my partner (not married).
She is currently on Tier 4 visa studying. We have been living together for more than 2 years, since 2012 June.

I read on the government website that we are eligible to apply for the extended stay (5 years scheme) if we are able to prove financially and that we have lived together for more than 2 years.

My question is what kind of documents do I need to provide?
Because the accommodation right now is registered under her name. However, I have the water bills (but don't have hard copy from 2 years ago) and not sure if I can print a bank statement stating I have stayed at the property two years ago?

The second question is the financial part.
I am currently a freelancer working for myself and we would most likely go with the cash savings of £65,000. Does this money have to be in UK bank? or can it be in a foreign bank?

Thank you in advance.
Alvin

Provided the funds are accessible , are lawfully derived and not borrowed, provided that the bank or building society were it is held, they issue a regular statement, the fund have been held for over 6 months, is regulated in the country were it is based, and provided the income is in your name or both you and your wife, or either, then there will be not issue in using it, subject to all the requirements in appendix FM-SE is met.

Thanks Obie, can the funds be in an overseas account? For example my parents will transfer the funds into an HSBC bank account overseas that is under my name would there be a problem doing so?

Also, any ideas on what documents are needed to prove I have been living with my partner for over 2 years?

Thanks!

Well if you parent gives it to you as a gift , then you will need to hold it for 6 months under your possession, before she will qualify.

As said before and Overseas account is fine.

See appendix FM-SE for the List of Document you are required to Provide

You must show that E-LTRP 1.2-4.2 is met.
