My husband overstayed on his student visa due to my pending decree absolute. We married in the same month, Islamic marriage and sent case off.
The solicitor based it on unmarried partner as I met him April 2011 and family life.
We have two children from my previous marriage whom my new husband is a father figure n supported my children and me emotionally.
We got refused in December, ex.1, LTRP 1.7, LTRP 1.2, 12.2.1
We asked for reconsideration and JR.
In the meantime both my solicitor and me asked for a copy of my husband passport to be faxed to marriage registry for civil marriage, as registry required this. This was not actioned by UKBA.
We arranged marriage in Scotland evidence that our case still in system. My husband got detained that he had no leave to remain and that his case had been refused for JR on 5th jan 2014. Neither I or solicitors had or have to date received this letter.
He was released the day after, and appeal given.
I have evidence that we live together as a couple, I have depression, and that we tried to get married. Is their anything else we can do?
