Apply for naturalisation once ILR is granted (Spouse route)

Post by kenzhh » Tue Mar 08, 2022 2:20 pm

Hello all,

I have looked in the forum but can't seem to find an answer to a question I have.
I am soon going to apply for ILR, through the super priority service. Hoping to apply for naturalisation shortly after that however I am confused: Do I need to wait to receive my new BRP before I apply? Does that mean I can't technically apply on the day my ILR is granted?

Thank you in advance for your help!

No.

You can apply as soon as your ILR is granted.

Thanks a lot Kamoe
Not sure I understand how as BRP is a requirement for naturalisation application, isn't it?
Do I not need it for my application?

I believe you can also use the UKVI letter or email(?) granting ILR as proof.
This is just my opinion as a member of this forum and does not constitute immigration advice.

You need to have ILR. That is different from a physical BRP.
Do I not need it for my application?
No. Not everyone has a BRP, e.g. EU nationals never had BRCs or BRPs.
The application asks if you have a current BRP, and you can answer 'No', and add details as to why not.

Here is also the relevant section from the AN guidance - https://www.gov.uk/government/publicati ... #documents

"Evidence of freedom from immigration time restrictions
Your passport showing permission to remain permanently in the UK
The Home Office letter by which you were given permission to remain permanently in the UK
If you came to the UK as an asylum seeker you should have evidence that you were not in the UK without permission between exhausting your appeal rights and being granted indefinite leave to remain.
Evidence of being freely landed, if you did not receive specific permission because you were freely landed as a Commonwealth citizen before 1971 or arrived as a child on your parent’s passport."
