Applying children passport - doubt -please help

Hi Seniors,

My friend on H1B, he was blessed with 2 children, recently due to some family problems, he took divorce and married to another woman.

Now, he wants to bring his children to US. He hold divorce petition and decree given by indian court. His petition mentions about children stay with father and decree does not talk about it. Both these docs are stamped and given by court that court. Are they sufficient to bring his children here?

Second question while applying for Indian passport for his children, in the mother name column whose name has to be written? (actual mother name or step mother name). In future, if step mom wants to stay with her step children, is it possible? Or can he write step mom name as mothers name? Please advise.
