APPLYING FOR EXTENSION OR ILR

I am on a spouse visa which is due to expire on 4th February 2008. I entered the country on 8th March 2006 and hence have not completed the 24 month period before applying for ILR. I have a genuine reason because my kids contracted chickenpox just as I was issued the visa and I have their medical records to this effect.

I need to know if I can apply directly for ILR or do I need to apply for an extension to complete the 24 month period. Please advise?

You do not need to complete 24 months before you apply for the ILR but rather 28 days short of 24 months. So, if you were to apply by post using a cheque, by the time your applcation is seen by a caseworker, you would have had the sufficient time required and would not encounter any problems. All this, provided you submit your application by post before the 4th of Feb and have passed your life in UK test as well.
