I have two questions. But first a little about my situation. I have been separated from my previous husband for sometime now and just recently we filed for divorce to get things moving. I have been dating a UK man for sometime now and we would like to share our lives together and get married.
My question is - my divorce is not final until mid January of next year, I am coming to visit my boyfriend for Christmas and stay probably 2 or 3 months. During this time - after my divorce is final we would like to officially be engaged and marry.
So, my question is: while I am still visiting the UK and my divorce has been finalized in Jan. can we file for a fiancee visa for me while I am still there or do I need to come back to the U.S. to do so?
Second question: If I need to be in the U.S. to file for a fiancee visa, would there anyway to do so before I visit at Christmas with documentation from the courts here stating that my divorce will be finalized in January?
I ask this because I do want to visit at Christmas, however I am saving up for the living expenses of possibly not having a job until we wed and I would prefer to only buy one plane ticket instead of a round trip plus another if I had to come back to the U.S. to file for a Visa here.
Any help is appreciated. I looked on the Visa site, but I think its assumed divorce is already finalized.
