Applying for ILR for Refugees

Post by internati29 » Sat Aug 10, 2013 5:59 pm

I've recently been granted Refugee Leave to remain for 5 years.
I was told that after five years have passed, I will be elegible to apply for ILR.
I'm interested whether that 5 years requirement is mandatory or that period of time can be less than 5 years, depending on circumstances.
Thank you for your responses.

Indefinite Leave to Remain (ILR) will be given to those who are still considered eligible to remain in the UK at the end of the 5-year period.

Assuming that there is no signeficant and permanent improvement in the country, asylum was sought from,
every refugee is eligible to be granted ILR after 5 years have passed.
(With a few conditions, obviously.)
But I don't want to wait for five years

You should expect to wait the same period as other applicants you can't just circumvent the waiting period because it may inconvenience you.

"The five year Strategy for Asylum and Immigration, published in 2005, refugees should normally be granted five years Leave to Remain (LTR) under par. 330 or 335 of the immigration rules rather than being given immediate ILR as previously"

Because there is used a phrase "should be granted..." ,
I thought it was not mandatory/compulsory to wait for five years

I applied for asylum back in June 2011 and after the initial refusal and following allowed appeal, was granted Refugee Leave to Remain in May 2013.
So It had taken just under two years.
Regarding your other request, as I am aware most of the claimants applications are determined within 6 months and only a few number of cases take much longer to decide.
Good luck to you :)
