Applying for IRL - what happens to my dependents?

Post by BlackViper96 » Sun Nov 26, 2023 2:47 pm

Hello all,

I am currently on on Skilled Worker visa, and wife is on dependent of skilled worker visa. I am applying for ILR, but my wife cannot yet as she has only been in UK for 2 years. Her visa will expiry in 2 years time, which is when my Skilled Worker visa will be due for renewal. My questions are:

1. After I get my ILR (in a few months' time), will my wife have to apply for a new visa immediately? If so, what kind of visa?
2. If not, after her current visa expires 2 years from now, what visa will she apply for?

Also, I have a baby due very soon, before I get ILR. When she is born, will she have to get a visa immediately? Or can she wait until I get an ILR?

Thank you in advance.

1) they stay in existing visa
2) they apply for skilled worker dependant again

If child will be born in the UK, you can register the child as British once you get ILR.

Thank you for the quick reply.

On 2) could she not apply as dependent of ILR holder? Or that kind of visa doesn't exist?

That is called a spouse visa for someone settled in the UK. FLR M.
If you venture on that route you would be resetting her stay in the UK. Her clock to obtaining ILR resets. 5 years starts again.
So choose wisely.
No sin in failing, you just have to try and try again!
