Applying for Permanent Residence for EEa family member

Post by zanesira » Thu Jan 14, 2016 4:14 pm

Hello,

I think my husband will be eligible to apply for permanent Residence in the UK as an EEA family member (as I am an EU national). His 5 years on EEA family permit here will end in August 2016.
He is a business owner, and very soon I will become employed by the business, as well as I do some shifts on a side for a care agency. My husband also very soon will leave his permanent job to devote all his time to the company.
I wanted to find out if we still need comprehensive health insurance in order to apply for his permanent residence because I think officially none of us are self-employed as we are employed by our Limited company.
We have been paying taxes via our business, we pay NI and we have collected 0 benefits since we arrived in the UK.
I currently have UK Permanent Residence document as I am an EU national and have been living and working in the UK for more than 5 years.
ALso, does my husband has to wait 1 year after receiving permanent residence in order to apply for UK citizenship?
what other thing can we do to make his permanent residence application rock solid?

Thanks,
Zane

As you have had the foresight to obtain a confirmation of PR document you have no need to exercise treaty rights any more.
You can simply sponsor your husband as he is your dependent family member.

Even if self-employed you would not need CSI, that is for self-sufficient qualified people (& students).
If you had needed it (which you don't) you wouldn't have been able to backdate it.

As you are an EEA national (& not a BC) then, yes, husband needs to hold his confirmation of PR for 12 months before shooting for privilege of citizenship.

To secure your application make sure you have unimpeachable supporting documentary evidence.
Also check any absences from UK (by you or spouse) have been within prescribed limits.

Good luck.
