Applying for residency with canadian spouse.

Post by P-O-B » Thu Mar 26, 2009 10:16 am

Hi,

Just found this forum and wondering if anyone can help.
My wife has dual citizenship (Canadian and British), she was born in Canada and lived there until she was 21. For the last 10 years since we have been together she has lived in the UK.
We would now like to move back to Canada, I am British.
It seems I can apply under the spouse / family class, however here is where my problem seems to start.
In order to apply under this class my wife either needs to be living in Canada or be able to show firm plans to return (I believe this would be something like a job offer, or a deposit on a house).

My wife is currently not working as we have a child, we would not move to Canada until I had a good job offer, I have a pretty good career with a US multi-national and would need something similar / even better. We would not move on the strength of her getting a job (she is a teacher and will probably return to work, but wouldnt earn enough to support the whole family). So - the only time she would have firm plans to return is when I can secure a suitable job. But I wont be able to apply for suitable jobs until I have the right to work there.... catch 22?
I am only just starting to look at this but im not sure how we get around the problem. Of course one way is to just leave my job over here show firm plans to move to Canada and apply for jobs when I get there, though this somehow seems a very risky prospect all round and dosent put me in the best negotiating position with new employers as I will have to take what I can.
Anyone have any experience of this?

Their goal is to prevent your wife pretending that she wants to move to Canada to get you the visa and then she stays in the UK and you move to Canada. So they want to see indications that you plan to move to Canada.

She might want to consider establishing some more connections with canada that can be used as evidence of you both preparing to move.

(1) Open bank accounts for each of you in Canada
(2) Get a lawyer in Canada
(3) Watch job ads in the Globe And Mail and submit those that interest you with your application
(4) Subscribe to a Canadian magazine.
(5) !!! Get a letter of invitation from some of her relatives in Canada which says that they will put you up (if that is true) or that they will help you settle upon arrival

Does your child have a Canadian citizenship card?
