Applying for Tier 1 (Gen) while Spouse in another country

Applying for Tier 1 (Gen) while Spouse in another country

Hi All,

My current status is H1B. I well qualified for tier 1 and got enough funds. But,,,,,,

I am in USA and wife is in my home country. I am planning to apply for Tier1(Gen) from USA. I want to make sure both of us have the visa in our hand before making the move. I do not want to be in the risk of me entering to UK and she getting denied situation. So what would be the best approach?

How should I go about applying for my spouse. I start searching information but I couldn't find any info regarding this,

1. So when I send the application for the tier 1 application do I get the visa stamp at the USA consulate or do I have to apply again separately in my home country for the visa with the HSMP approval letter?

2. Could I include my wife in the application process even though she is not with me here in USA? If not how should she apply from my home country. What are the documents does she need for her application?

Could someone please clarify and it would greatly help me.

I think first you should apply for Tier 1 visa in your country of residence. Only after you get visa, your wife can submit Tier 1 dependent application in her country of residence.

if that is the case how does the maintenance savings work? Do I have to show both my £2800 and £1600 during her application? How do they connect the dots to my application?

in a separate note I hear people talk entry clearance. I thought with the tier 1 you just send one application and you get the visa. and in HSMP days u get approval and then visa. I believe I am correct. If that is the case what is entry clearance?

Yes, you have to show 2800 + 1600 GBP. Well, if she could show 1600 GBP in her account, maintained for three months, then it would also be okay. She has to provide the supporting documents that she is your dependent.

Yes, that is right, if your Tier 1 application is successful, you get visa/entry clearance straightaway. Hope that helps.
