Applying from a country different from home country

Post by ravimuppa » Sun Jun 29, 2014 7:44 pm

Hello All,

I'm from India, currently studying in Spain. I'm on a 180-day student visa which is valid until Nov 2014. However, my internship in London starts in September (ends in March 2015). I'd like to know if I can apply for the Tier5 (creative, as I work in film business) visa from Spain, without having to go back to India.

Thanks!

In theory you could because you're in Spain on a valid status other than visitor, BUT I don't see how anyone could issue you a Tier 5 creative CoS to be an intern. How would you meet the code of practice?

Thanks for your reply.
Could you tell me what would be the appropriate visa in my case then?
A little context:
I'm on a 9-month masters program in audiovisual management in Spain (3 months training in spain with 6 months internship) and my internship would be in London to finish the program.

Outside of exchange schemes like BUNAC there is no legal way I know where a non-EEA national can do an internship in the UK. The UK's immigration scheme is loaded towards skilled workers who offer something we don't have. Interns don't fit that. Sorry, but I don't see how you can do what you had planned. Perhaps some other EU country might allow it?

There are a couple of Tier 5 GAE schemes that cater for this circumstance. The areas I am aware of are the legal profession & accountancy. There is a more general sceme bringing in people to do a one year business program but that is very much big business oriented.and they are sponsored by existing emploters overseas.
In order to gain a Tier 5 CW you need to be sponsored by a licenced organisation in the UK - if that is not the case you can not apply for the visa..
