Baby Born in India+Father has UK Passport+Mother on ILR

Post by sudhajo » Mon Aug 10, 2015 3:32 pm

Hi All,

Great thanks to all who support and share the information. I am very much confused regarding of which route is best to get my baby quickly from India.

I have recently got British Passport and my Wife has IRL. She went to India to deliver the baby in the month of Jan 2015 and delivered boy in the month of June.

1. I know that the baby is eligible for UK Passport, but i am scared that going for UK Passport nearly take very long. Standard is 16 weeks and some friends say it will take long time than that. So want to check if there is any better route to get them quickly

2. I dont know if i can apply ILR for the baby as myself being the primary sponser. Will the UK embassy will approve the ILR or not. We have not taken Indian Passport yet.

So can anyone please advice what is the best way to proceed.

Was the child born in India before you naturalised or after?

1. If you were naturalised prior to your baby's birth, then baby is indeed automatically British.

2. It would be inappropriate for them to grant leave to enter/remain to British citizens.

Hi Vinay,

Thanks for the reply.

So you mean to say that we should not apply for ILR, rather go for the British Passport as the child is eligible for the passport.

The time lines are very long thou :(

Regards,
Sudhakar.

Options:

1. British passport from India
or
2. CoE-RoA on an Indian passport
