Baby born in UK with parents on Tier 1 visa

Post by Vinny1976 » Sun Nov 30, 2014 1:40 pm

Hi,

Could you please assist on the below query.
Do I need to apply for baby ( UK born in Nov 14) tier 1 visa at the same time when I apply for my visa extension. Or can I wait for my ILR which is due in Sept 15 without applying the tier 1 visa for the baby born in UK.
Below are the details for the same.

Tier 1 Visa expire date : 22 June 2015
ILR Eligibility : 28th Sept 2015
Current length of stay: 4 years & 2 months
Baby born: UK. 3rd Nov 2014.

I am planning to apply for the extension in the month of Feb 2015. Can you please let me know if I can apply directly for ILR (due in sept 15) for baby born in UK without applying for Tier 1 visa for the baby.

There's no requirement for a UK-born child to apply for leave to remain, if not travelling.

Thank you for the quick response.
Just to re-confirm I don't need to apply for UK born baby a tier 1 UK visa as long I am not travelling outside UK. I can apply for british passport for the baby when it's due for ILR.

No. Registration is required before baby may apply for a British passport.
