Baby's first UK passport - asking for grandparents birth and marriage c erti

Post by SebilAb » Sun Apr 04, 2021 10:06 am

Hello

This may have asked here already but i could not find it..

I hold ILR for last 11 years. I was filling the application form online for my baby's first uk passport. He was born in the UK in jan.

Application is asking me to send both grandparents birth certificates and marriage certificates.
We do not have this as they live in their own country

I contacted HMP through their webchat and they took my details and said someone will call me.

I am just posting this here to see if i could get any info on this before them contacting me.

Is this a mistake and they actually need these certificates of my baby's grans

Hope someone can advise

Thanks

Probably a mistake. Baby is automatically British because of birth in the UK and your ILR. Grandparents’ circumstances are irrelevant in these circumstances.

Keep your ILR safe.

As Vinny already stated Grand parent’s details are irrelevant.
You only need to send HMPO:

1) Baby’s original UK birth certificate.
2) Your original ILR BRP.

I used the following cover letter for my daughter in a similar situation. You may use it too.
To,

Her Majesty’s Passport Office

RE: First Child British Passport Application
Child Applicant: [Name] [DOB]
Application Reference: PEX XX

Dear Sir/Madam,
I, XX am the mother of the above named child applicant. I have Indefinite Leave to Remain in UK i.e. settled status since DATE XX.
Please refer to:
British Nationality Act 1981
1981 c. 61 Part 1 Acquisition after Commencement Section 1
Acquisition by birth or adoption
(1) A person born in the United Kingdom after commencement shall be a British citizen if at the time of the birth his father or mother is—
(a) A British citizen; or
(b) Settled in the United Kingdom

According to the above provision in law, my child is British by birth; at the time of my child’s birth, I (mother) had settled status in the United Kingdom.

Please find enclosed the following original documents:
• Original Indefinite Leave to Remain Biometric Resident Permit Card - XXXXX (mother’s settled status in UK)

I believe the above documents are enough to prove my child’s claim to British Nationality.

Please feel free to contact me if any additional documents are required.

Thank you,
Kind Regards,

If the UK birth certificate (child) shows your name (father) also as a parent, then I believe no other document is needed. It is best to add mother’s consent and get her signature too and add marriage certificate (if applicable). Mother’s passport and BRP is unnecessary in this case (assuming she is not settled yet?)
