hi i want to be clear if i would have a problem with spouse visa, i was in uk illegally, but am back home to apply for spouse visa, but my main question is when i was in uk my partner used to claim working tax credit and child tax credit, but i was not included as joint to claim this, now i have read that for working tax credit you must claim jointly even if i was under immigration control. now will this affect my application.

So you were not named, and your income was not disclosed? Or was it the case that you had no income?

yes i was not named in any forms she filled for those benefits, also i was not working as i did not have papers, so i didnt have any income,

At least that is a "saving grace" as it shows that your wife ended up getting the same amount of Tax Credits, as the two of you would have obtained if the correct joint claim had been submitted.

I reiterate, and not just for your benefit, in respect of a couple living together, a Tax Credits claim must be made in joint names. There are no exceptions to that.
