UK born son - Parents and son deported

Post by kavita_mane » Fri May 09, 2014 4:15 am

We had taken political asylum in the UK from 2000 to 2008.

Our political asylum case was rejected and we were deported in 2008 for overstaying.

I had a son in 2007 in the UK in Southall, West London in Hammersmith Hospital.

My Son has a Birth Certificate and GP/Hospital records from the same hospital.

Is my son eligible for UK citizenship ? Since his birth certificate is from UK I cannot get any government documents in my Country (India) for him.

What is the best way for me to get UK immigration to recognize my sons eligibility for UK citizenship ( if he is eligible given his birth in the UK )

Please advice - THank you

No I'm afraid not, your son would only be entitled to register as British if you settled in the UK.

he can not get british citizenship as he is born as you mention during 2000 to 2008 and he was your dependent so whatever is the status of parents child will have same status .british citizen ship is not automatic right on birth
You may have to fight a battle more than once to win it.
