I need some general advice.
After a FLR (M) Partner visa has been granted, one of the visa conditions is that the applicant must not 'recourse to public funds'.
If the applicant without notifying the sponsor (British Citizen), submits a Universal Credit claim, am I right to assume that the DWP will prevent the claim from going ahead as they would undertake immigration checks.
I want to know:
1. Would the DWP inform the HO or just give a warning to the applicant from their end.
2. If the HO find out that an application has been submitted but no monetary benefit obtained, what action would they take? I have read that in some cases, they will change the ILR route from 5 years to 10 years and in other cases, their spouse visa will be cancelled and a ban imposed.
