Bringing Wife into UK, previously banned.

Hi, sorry to bother you guys. I will try to keep this as short as I can. 2yr ago now my American girlfriend of 11yrs was found to be overstaying and left voluntarily for a 12 month ban. Her reasons for overstaying was I was bed ridden and dying due to my own stupidity so she stayed to look after me after only wishing to stay for a month. She had planned to return homeless and look for a lost family member. She was found to be overstaying and left the uk.

Last year she tried to re-enter the uk using a visitor viasa for 2 weeks after her ban was complete but she was refused entry with no information given as to why she was declined. She gave evidence she was living in a home she pays rent for, has bills, has a job caring for elderly people. Most importantly I have care and no longer bed ridden so ne chance of her needing to care for me again. The reason she wanted to return was my mother was about to die and she wanted to see her one last time and she gave evidence for this too.

Fast forward a year later and my mother has since died. We decided life is too short and we want to marry. I applied for some stuff and can travel to the US to marry her. I do not wish to leave the UK to live in the US my father is now alone. After marriage I would like to bring her to the UK. It probably wont be right away as she is busy looking after elderly people. I'm sure in this time she wont be able to visit me either as they probably have more reason to deny her entry. My question is, one day I would like to bring my then Wife to stay with me in the UK. Since she has a previous ban that is over but apparently still very much important, will this likely effect her for coming to be with me here? Any advice would be much appreciated.

She was likely denied entry after the ban because the ECO believed she was an overstay risk and because of her poor immigration history.

As long as she hasn't used deception, this ban should have no effect on a spouse visa application, which is decided under different rules. You (and she) just need to meet the requirements of a spouse visa. All info on previous history would need to be included, but is unlikely to have any bearing on her application.
