MrsT wrote:Hello,

Maybe someone might be able to shed a light on a mystery that I have not yet solved. It might be too late for me as I have already handed in my neutralisation application via NCS, but it might be useful for other EEA nationals who have to fill in the application form.

In the application form it states under 1.3:
1.3 Please say when you were given indefinite leave to enter/remain in the UK (not necessary if you are a Commonwealth citizen with right of abode in the United Kingdom). If you are an EEA national, a Swiss national or a family member of an EEA or Swiss national you should read pages 10 to 11 of the Booklet
AN.
Reading page 10 Booklet AN it states:
This section covers you if the country to which you belong is part of the European Economic
Area or Switzerland. If you are a national of a country which is a member state of the EEA or Switzerland, or the family member of such a person, you will automatically have permanent residence status after exercising EEA free movement rights in the UK for any continuous period of 5 years ending on or after 30 April 2006. You should apply for a permanent residence card to prove that you hold that status before applying for citizenship. But remember that, unless you are married to or the civil partner of a British citizen, you should normally have held permanent resident status for 12 months before applying for
naturalisation. This means that you may need to wait until you have been in the United Kingdom for 6 years before you can apply. When you apply for a permanent residence document the evidence that you supply for your EEA(PR) application must be for a 5 year period that ended at least a year before you want to apply for citizenship.
First I assumed that the date asked for under 1.3 is the date when the PRC was issued, however this date is required at 2.4 of the application form. Then I assumed being an EEA national, the date must be five years after I entered the country and started exercising my treaty rights, as this is when EEA nationals automatically get indefinite leave to remain in the UK.

During my NCS appointment I asked which date was the correct one to put into 1.3. and lo and behold, the registrar did not know and I was told to put down the date 5 years after I had started exercising my treaty rights. I came here in 2006, so 2011 should be fine as you're far over the required 3 years for someone who is married to a British citizen (quote). Whether or not this was correct, I can't say.

Could anyone shed some light on this date issue, please?

Kind regards,
MrsT

I was hoping to get some help on the following part of form AN:

1.16 - Present address and date from. The date when I signed the contract for the current house (18 Jan 2015) and the actual date when I moved in are different. So, when I filled the application form for ILR last year, I put the an approximate date of when I moved in - it was a Saturday. However, now I cannot remember what date I put down on last year's form (21 Feb 2015 or 28 Feb 2015). Whichever of the two I put down for the AN form, if there is a discrepancy would that be a problem?

Would they even check my ILR application form from last year?

Sadly I do not have a copy of my ILR application.

Thank you.
Month and year should be fine.
I have a similar query. What is best just month and year or an approximate day as well? Surely, this would not be grounds for refusal or complication - I hope. Would that be OK?
Go with CR001's recommendation.

When it comes to absences, I plan to provide an Excel spreadsheet which is what I did for ILR as well.

I just wrote "please see attached spreadsheet".

I assume it is also fine to do this for naturalisation. Is that OK?

Don't see why not especially if you have lots of lines - main thing is to stay within the residency requirements.

I know this may seem silly but Can anybody advise on how to answer these questions please:

1.7 Name at birth if different from above. (If the names you have given are different or spelt
differently from the name shown on your passport, please explain why on page 22):

I have added my husband's surname when got married but haven't removed any of my birth surnames.
Should I mention it?

1.49 Address of tax office or tax office reference

????? what is it?

6.1 Have you been issued with a BRP with a previous application for leave?
Permanent Residence Card as a Non-EU should be declared again in this section?

1.7 Just state name you had at birth.

1.49 If a taxpayer, look on a P60 or any letter you have from taxman.

6.1 A UK BRP is not an EU card, its a domestic UK card and you don't have 'leave to remain' under UK Immigration Regulations.
If on EU route you don't have one.

Thank for your reply.
So should I mention my name before getting married and explain on page 22 that I have added husband's surname when got married?

I have provided my biometric information when I applied for my Resident Card. Still no need to mention? No need to return my card either?

Explain it if you wish.
Caseworker is used to processing applicants who happen to have changed name due to marriage.
She does it day in, day out; they can figure it out.
But if you wish to explain it it can't hurt.

Q6.1 No.

You will have to enrol biometrics as part of the naturalisation process.

Biometrics previously provided as part of EU application is separate and does not exempt you.
But you do need to submit PRC as part of proof you have acquired PR.

Dear Noajthan:

Hope you are well, and have enjoyed your xmas turkey! :-) Just being curious to check something in the form (Form AN):

Q 1:
Section 6:
6.1) BRP is something to do with ILR (UK route), and not the PRC card that i am expecting to get the next few months! So the answer is NO, and jump to 6.16, and then is NO again, and then 6.17 which is the declaration (however as family member of an EEA national who has just applied for PR, i have already submitted my Biometric enrolment, is that mean i have to to fill section 6) (6.16 and 6.17)

Q 2:
section 7:
7.7) Just to double check what exactly need to be deleted! Just to see if this is similar what i have in mind?

I'll jump in with my 2p worth (based on my own application)
Q1: you will have to give separate biometrics as part of the AN application (I know it sounds like overkill) - so you won't have a BRP card therefore answer NO and the follow instrucions. Certainly this was the case for me as I never did biometrics.
Q2: strike out the whole question - each line unless it applies to you....

Re: Q2: the whole paragraph from I declare to,,,,,to fulfil them
You are confusing yourself.

PR application is nothing to do with naturalisation.
Biometrics filed for EU/PR has no connection with naturalisation.

Biometrics have to be enrolled by all applicants for privilege of citizenship.

Its not about what makes sense to you (you are overthinking it by taking that approach), nor is it about what saves you money - its about HO finding out who you really are. Just do it.

AN FORM
1.50 Employment history in UK during past 10 years, or since date of entry if you have been
here for less than 10 years

AN GUIDE
You must provide details of all your National Insurance contributions made
for your current and previous employment during the past 10 years. To support this
claim evidence can be in the form of payslips, P60s covering the relevant period, or a
letter(s) from the employer(s) confirming you have worked for them, from the start
and finish date.

If you do not pay income tax through PAYE you must demonstrate that you have
discharged your obligations towards the H.M. Revenue & Customs, by attaching a
Self Assessment Statement of Account.
I did not pay income tax at all for one of my jobs, because I was below the threshold (and it was part time) Also I was in uni back then, so that period will be covered by a letter from University.

Will I need to provide much evidence for that job or not really? I have an HMRC letter from that period that mentions my tax code, but other than that I don't really have any more evidence that I worked there or that I was exempt from paying tax. As I said, studying was my main occupation back then, so do I need to worry about this part time job?

Remember HO are checking good character too - including compliance with Immigration Regs;
forget Santa, he's a pussycat, you really do not want to end up on HO's 'naughty list'.

Suggest supply everything; caseworker can then pick and choose what she needs to see.

Thanks :D In hindsight, it's pretty obvious that I have to send (good) evidence for literally all employment, no matter how insignificant.

I contacted HMRC today and they told me they can send me a statement that covers 2011 - 2015, which includes my part time employment for this company. I will however try to get this company to produce a letter that confirms my employment, but in the meantime I am trying to get as many alternative documents as possible. My main worry is that they will either refuse to give me such a letter (though they don't really have a good reason for that!) or they no longer hold records about me, though it wasn't that long ago.

Anyway my other worry is proving physical presence exactly 5 years ago (in February). For this I will provide 3 documents:

1) letter from HMRC dated exactly February 2012, which also mentions the company where I worked part time
2) University graduation diploma, dated 2013
3) Letter from university that mentions when I attended and that period includes February 2012

If HMRC send me the statement that shows I was employed in February 2012 and if this company send me a letter about when I worked for them (which includes February 2012), I think my evidence will be quite solid.

Does this sound about right?

If physical presence 5 years ago means some day in Feb 2012 on basis of applying in Feb 2017 then it sounds a very reasonable, measured and comprehensive approach.

Hi all, probably a silly question but the residency requirement is still a bit confusing.

- Received first Tier 1 visa: 15 Mar 2011
- Received ILR: 19 Feb 2016 (because I applied 28 days before completing 5 years)

So now for BC, can I apply on 19 Feb 2017 or should I wait until 15 Mar 2017? i.e. is it 5 years + 1 yr = 6 years?

19 Feb 2017 and it is the most recent 5 years residence that counts for citizenship. Make sure you were physically present in the UK on exactly the same date in 2012. If you were not, your application will be refused.

I'm trying to understand the concept of "gaps" in the context of this form and application. I have the feeling the requirement to exercise treaty rights + prove residence was much more strict when I applied for DCPR than now.

For example how many documents are enough to prove I have been working between 2014 and February 2017? Are the following enough: P60 from 2014, P60 from 2015, P60 from 2016 and letter from employer that covers up to February 2017?

On top of that I can add an HMRC letter that lists my employment over the past 6 years. (I did not work before that)

Before that I was a student. Is the University diploma enough? Or is it absolutely necessary to have a letter from the University that mentions attendance? If so, is the graduation diploma useful at all? I also received a few letters from HMRC (I worked part time during studies), are they needed or do they help? Or one document (letter from university) is enough?

Also what about the times I was a jobseeker? Do I even have to mention the gaps I have in my timeline? (i.e. periods when I was in the UK, but I was not studying nor working)

HI All,
just a quick query regarding the question 1.48 about the 10 years employment history in AN Form for BC. During the last ten years I worked as self employed only for few months along with my full time job, Now do i got to mention this as well or just give my employment (jobs) details.
Secondly, for my jobs do i have to give 10 years P60s or the employers letters will be enough as i just have last 5 to 6 years P60s.

This is not an action replay of a PR application.

It is not necessary to prove you were working.
It is not necessary to justify unemployment.
Economic activity is not mandatory when naturalising.

If you did work you just have to submit proof of meeting tax/NI obligations.

Aside from that you still have to prove residence in UK. As per AN guidance.
That is where letters from government, quasi-government and other official bodies (university, employers, medical authorities & etc etc) can help.
All that is gold does not glitter; Not all those who wander are lost. E&OE.
