Hello Everyone
Before I get my refugee leave to remain I was over stayed. now i have refugee leave to remain
I have to apply refugee settlements soon.
My question is that if I was over stayed am i still eligible for british nationality???
I m so confused.
Can anyone help me please

You need 10 years legal residence for citizenship usually.

I suggest for us on your ilr first.

Thanks for your prompt answer so after I apply file I have to wait another 5 years for british nationality??

Then fresh claim i meant fresh application it was refused again
Homeoffice arrested me from house
Applied asylum its refused
Got right of appeal

Leave to remain or INDEFINITE leave to remain in 2018??

I specifically asked what date you were granted your 5 years leave to remain (not ILR).

The Good Character requirement came into effect in 2014 and NOT 2019.

The policy applies to everyone applying for citizenship.

Hi everyone
Your prompt response will be grately appreciated.
I arrive to UK in 2006 as a student and was relgally residing in UK until 2011 but for unfortunate reasons I overstayed from 2011 to 2014. Granted a refugee status in 2014, just got my ILR Set P few weeks back.
My Q is will I qualify for Citizenship after 12 months period or HO will refuse my application based on good character? I have always abided the laws and never involved in any troubles what so ever. Please help with your opinion and avice.

You need to apply in 2024 .HO will refuse you if you apply before.It is very hard to wait for 10yrs .HO is run by Tory Crooks they know how to make things difficult.The only hope is if labour wins they might change the rules but if Tories win again they will make the rules more difficult than this.

Im in same situation like you.After refugee ILR we have to wait another 5 yrs &then can apply for British Nationality.This is the game HO playing with refugees.UN refugee guidelines clearly mention not to penalise refugees for illegal entry or overstaying but UK HO is hostile &makes difficult rules.Some people have taken HO to high court on this good character issue but got refused from there as the judges say HO has discretion to change rules.
So can I travel to my home country on refugge settlement ????

If you hold refugee ILR after applying on SET P, then no, you should not travel to your home country you claimed asylum from. It could cause your ilr to be withdrawn and revoked.

I haven't applied as it is waste of money .I strongly advise you &others not to apply as HO will definitely refuse &keep the money .Some stupid lawyers advise clients to apply as HO can apply discretion.HO doesn't apply discretion in such cases.Simply shouldn't expect something human from them.Im thinking to go to another country .If I'm successful I will update here.Waiting for another 5 yrs is bloody too much.
