British Citizen Application (Tier 1 Accelerated ILR)

Post by tier1entrepreneur-AA » Sat Apr 17, 2021 5:08 pm

Hi Team,

I have obtained my ILR after three years or residence under Tier 1 Accelerated ILR route,

I intend to apply for British citizenship once I reach the 5 year residence from the day I first entered the UK under this category (early Jan 2018), so I will apply for British citizenship in Jan 2023,

Absence limits:
Year 5 (Jan 2022 to Jan 2023) - I'm only allowed to be outside the UK for 90 days.. this is clear.
Year 1 to Year 4 - I have a limit of 450 days -90 days = 360 days.

In my case:
Year 1 to Year 3 - Only 100 days outside the UK

Is it right that I can stay outside the UK during my fourth year of residence for maximum the remaining allowable period (i.e 360 days - 100 days = 260 days), so it can be more than 6 months during my fourth year without break my residence requirement for a British Citizen Application?

Thanks in advance.

You will qualify in Jan 2023.

Lets say you apply on 20th Jan 2023 (example) (assuming when you will complete 5 years residence in UK).

You can not be outside UK for more than 90 days from 21st Jan 2022 to 20th Jan 2023 (last 1 year).

You can not be outside UK for more than 450 days from 21 21st Jan 2018 to 20th Jan 2023 (last 5 years).

You must be physically present in UK on 21st Jan 2018 (start date of the 5 year qualifying period).

*The above dates are an example for you to understand the requirements. Adjust the dates accordingly in your case.

Your understanding is correct. It does not matter if you use chunk of your allowance in the 4th year in your case as long you meet the overall absence limit as stated above.
