To the best of my knowledge, there isn't a department that deals with the kind of queries that you have raised.

The Passport Office will almost certainly have taken legal advice themselves from their own lawyers before issuing you the letter denying your granddaughter the passport (and as I have stated earlier in this thread, I believe that their reading of the law is correct).

The only way I can see for you going forward is that you will need to go to court for a declaratory judgement stating that your granddaughter is a British citizen and requiring the Passport Office to issue her a passport.

Apologies if this enquiry is posted on the incorrect site but I do need guidance on where to get proof of my daughter’s immigration status (with her permission) and all enquiries from the Hime Office are looped to the FAQs. which do not help with this issue.

I was born abroad and received my British citizenship by descent from my British born father.
My husband and daughters accompanied me to the U.K. in 1984. After 5 years,my husband was successful in getting his naturalisation and my daughters were successful in their respective registrations under 3.1.

Question
How and where do I write to to get documentary proof that they are “otherwise by descent”.
I am asking this because the passport office has rejected an application for my grandchild who was born overseas. The passport office has given the reason that my daughter is by descent and therefore cannot pass on her citizenship. Incorrect.

This is incorrect but no one will listen to me when I explain the it is me (grandmother) who has citizenship by descent and not my daughter. She has a registration in her own right and if I can prove that she is otherwise by descent then I can challenge the passport office. My daughter was also born overseas. Her registration document only states 3.1 but does not state that it is otherwise by descent.

Also the BNA states that citizenship by descent can only be passed down one generation ( father to me) and not twice as the passport office are suggesting.

How do I get proof for my daughter that she is otherwise by descent?
