i have read that page and that persons story, but if you read his story too you can see that the guy has not declare his points and offence on his application form, that was his main reason for being refused.
beside not every case is treated as same, there are situations like your insurance was canceled by insurance company for an error in payment and the driver did not new about the cancellation, those are the situations that secretary of state can look in to in case to case bases.
i've never had any traffic offences i've even had 7 years no claim bonus, what kind of person in a right mind with this history of no claim bonus is willing to destroy everything for just a lousy insurance.
it was a clear mistake, i've even had another insurance on my other car and on my bike, anyway according to my solicitor it's nothing to worry at all, so i guess is wait and see.

hi to everyone.

i didn't want to share my story with anyone on this forum after what happened last time and some dearly beloved idiots start wishing me go to prison for my driving offence and also wishing my application get refused and the worst part the moderator actually blocked me instead of blocking them, any way i'm so happy that i couldn't not sharing my story with other good people in here.

i had an appointment on 30 of Apr at NCS to send my naturalization application, i have confirmed my driving offence on my application as a result the lady in NCS said that she has to contact HO to confirm that if i can apply, they told her over the phone that i have to wait 5 years before apply, and if i apply now i will be refused.
i did not send my application and contacted my solicitor who was assuring me that i will be fine with my offence,

he has sent my application on 7/May

money withdrawn 12/May

got the confirmation of receipt of application on 18/May

i have called HO on 4/Jun and they told me the decision was made and it will take 10 working days to receive the decision.

today 8/Jun my solicitor called me and said that he has received my approval and can go for my ceremony by next week.

against every odds and everyone telling me i will fail and waist my money i have trusted my solicitor and thank god he was right and he proved everyone wrong, i am now british and will go for my ceremony next week and apply for my passport.
thanks to those who has gave me comfort with their words and wished me luck, good bless you all and hope you all get your citizenship soon

When I read your story in the forum I am the one who really felt pity for your circumstances. I am really happy now to see you won

Mistakes are of two types Doing it knowingly and Doing it unknowingly

But unfortunatly even doing a mistake unknowingly falls into same conviction as doing mistake knowingly. Law doesnt know human feelings, all it knows is what is written in book. This is applicable to all countries in the world.

anyway I am very happy to see your success after all these hurdles

I think these NCS people are a waste of space, frankly. No one should spend their hard-earned cash on the service if they can help it. In a similar fashion to you they did all they could to discourage me from applying.

On a lighter note, i'm sure many who took a dig at you earlier when you explained your situation including mr. moderator are eating 'humble pie' on account of your success.

Everybody makes mistakes...its funny when holier than thou, self righteous people try to bring you down.

it is kinda sad that how many dearly beloved idiots are living in this country and they hate immigrates who build this country, if you read all the comments you will see, that an idiot has compared me and people without insurance to Hitler, another idiot think that i should be in jail for driving without insurance and wished my application get declined, can you believe that? i think they are part of BNP that hate immigrants, and they try to give us a wrong advice.
anyway i have got my citizenship and nothing can get it back.
anyone out there who is in a similar situation, be honest with yourself, if you are not rapist, killer or terrorist, and have a good reason then find a good solicitor and go for it, dont waste your time and wait for 5 years.
50% to 85% of drivers in uk have some sort of traffic offence one way or another.

First and foremost, congratulations to you matinuk2.

Secondly, I've come across a few replies on different topics written by a certain 'Wanderer'. This person is a complete muppet. His replies on this thread proved how immature this person is.

Thirdly, certain people think they know better than a solicitor. Although I do respect that some people (for e.g Moderators) know a lot of stuffs but at the end of the day I dont think any of them would know better than a professional.

Lastly, feel free to have a go at me but just to let you know that it wouldnt bother me at all. I know sometimes or most of the times TRUTH hurts.

All i know is many people put this guy down...i read somewhere earlier that his application was bound to fail....and that he should pay £360 for advise instead etc....lol....so this is good news. Lets just try to get details of his story so as to encourage others

the funny thing is that all those idiot dearly beloved who were mucking me and wishing me to fail and go to jail or were comparing me to Hitler now are shut up and won't say a word as they have nothing to say.
as i said before they don't have any idea about law or anything for that matter, they just see things in black and white, thank God they are not working for HO and are not in charge of deciding for peoples life.
to be honest i am not saying that having a traffic offence is ok, but there is no such a unsensible law in any other country, i would understand they refuse the citizenship if you have sexual conviction, or committed murder or you are terrorist and generally treat to public safety and security, but being refused for traffic offence specially when it's been unintentional is a bit harsh, but anyway it's not for me to decide.
all i wanna say is that although i was stateless, but my solicitor did not mention that, all he mentioned was to explain why i committed that traffic offence and the fact that it was genuinely unintentional and all a big misunderstanding, and it's less likely to happened again, thank God that case worker are understanding and take discretion and treating each case differently.

Thats what it matters. If it was a case of plain driving without insurance, then I really doubt they would have granted BC. There are a few offences which are strict liabilty offences. That means that even if you did them totally unintentionally, you will still be found guilty in court. Magistrates have no discretion at all regarding this. There was a post from someone who bought insurance online, and got a bit confused about the actual start time of insruance cover. He got stopped by police 20 minutes before his insurance was due to start. He still got done for it. He would still be found guilty of driving without insurance. On the other hand, if another person drove a car without insurance fully understanding that he is driving without insurance, if caught, will be guilty of exactly the same offence. Both of this people will get same IN10 code on their license and both will have 5 years rehabilitation period, even though one guy did it by mistake and the other guy did it deliberately. Same is the case with driving without road tax. Magistrates have discretion about the amount of fine, but absolutely no discretion to find the person not guilty of offence.
UKBA guidance is clear that people with these convictions should "normally" be refused. But if an applicant can prove beyond doubt that the offence happened by mistake and not deliberately, then there can be a good scope of a caseworker exercising discretion. So, I dont think same yardstick can be applied across the board, and every applicant should deal with their case on the merits of their individual circumstances.

You won't believe how happy I was for you when I read that you got your citizenship.

Reading your story from when you first struggled to get your PR I felt it was really similar to mine and while you get discouragement from so many people all around what counts is the result. I hope I will also be able to be successful first with my PR and then Citizenship with traffic offences.
I would be eternally grateful if you could let me know which solicitor represented you or at least which firm he/she works for as I'm really struggling to find someone who knows enough about eea law.

Anyway congratulations and thanks so much for keeping everybody on here informed about progress and outcome of your case.

4 May 2009 applied for my PR
29 Feb 2010 received my PR

7 May 2010 applied for my Citizenship with 6 points in my license for driving without insurance and £185 penalty which i am still paying(happened in Sep 2009, i decided to go to court to challenge the decision), more than couple of CCJs :cry:

everyone said i have to wait untill 2015 and if i apply i will be failed, they even compared me to Hitler and said i have to be in prison , and thanks to moderator the put me on thin ice as you can see, but never mind

12 May 2010 fee was withdrawn

18 May 2010 received acknowledgement letter

4 Jun 2010 received the confirmation of approval by my solicitor

14 Jun 2010 confirmation letter for ceremony

16 Jun 2010 private ceremony

22 Jun 2010 send the passport application by check and send in post office

1 Jul called and received the ref no for booking for interview

5 Jul interview down in Crawly

8 Jul at 12 am someone dropped a white envelope in the mail box without even knocking on the door, it was my red British passport

nothing was sweeter than that.
after all payments to solicitor and fees to HO and passport and everything, i am pretty skint now to go for a holiday, but booked a 2 weeks holiday to Vegas for Christmas though :P :twisted:

We all make mistakes, and we sometimes pay dearly for them. Some traffic, some others, but we do suffer a times.

1. Did you get Indefinite Leave To remain with your traffic offences? Or

2. Did you commit the traffic offences after ILR?

i have applied for my PR in May 2009 and my traffic offence happened in Sep 2009, but my PR wasn't even with caseworker until Dec 2009 and was approved in Feb 2010.
when i applied for my PR i had several CCJ though, but my solicitor filled my application and he never asked for any CCJ or any traffic offence.

Congratulations Man, this is worth celebrating and a massive THANKSGIVING!

I was also one of the doubters when I was going through the advice and condemnations in the forum, though I never criticised or advised negatively but having read more negative than positive I began to think that you might not make it but I was proved wrong at the end by your shared faith in God and ur lawyer and committing absolute tenacity and fighting every negative contribution that was ever posted against you.

I have learnt a great deal in this unfolded positive Saga. Great for you MATINUK2!

I have pleaded guilty by post for LC20-Driving not according to licence- fined 150 pounds and 3 points off licence in June 2010

Am due for ILR in August 2010. I am going to put this information in my application.

This is the only issue I have. Am worried, but am keeping faith that all will go well.

I am praying this wont affect my application.

Greetings Every one,

though this post is very old, but i thought it is wise to share a bit of knowledge with you guys. as long CCJ is concerned, it will not make impact on any home office application because its not a criminal court. people might loose and may not be able to pay their mortgage doesnt mean they are criminals, people go bankrupt bcos of recession doesnt mean they are criminals, as long criminal court is concernd it has to be mentioned in all applications to HO, Specially Traffic offences. Because it can cause damage to other citizens. like if you try to kill some one in street.. is a criminal offence while drunk driving could also end up in human loss, by not paying your electricity bill bcos u dont have money will not let your provider commit suicide.

or Anything that appears on CRB ( Criminal Record bureau) file has to be there in HO applications.

Hope it helps. all information is self experinece based.

i have 6 point in my licence and i had fine of 200 pound i have never been to the court my self but it said in10 convention on my licence.
what i want to know ie did you mention it in you form or not ?if you did how did you expian it in the form

Firstly, congratulation with that, and thanking for sharing your case with us.
I have the similar situation with you, I was been caught for driving without insurance, and pay the fixed penalty to police and 6 points on my driving licence without any further action (i.e court or anything like that).

I am about to apply my pr for 10 years lawful uk resident . I am so glad to hear such a good news from you.
Can I ask you, by any chance you could let me know that if you wrote a full explanation letter in regards to that, what documents did you provide together with your application?
