Hello All,

I've been granted ILR last December 2013 following 'Legacy cases'. Does anyone know that the discretion could apply to me for early naturalisation application?

Immigration history:
1. Entered UK in December 2006, applied asylum. Been granted DL (until October 2008) after asylum was refused in February 2007 .

2. Lodged in-time further leave application before DL expired.

3. Received acknowledge letter from HO confirming my case was among legacy cases handling by IND.

4. Case was transferred from IND to CAAU then to OLCU.

5. Got ILR in December 2013 after about 5 years waiting.

6. Live with partner and two children ( under 5 years old)

Thank you for your advice in advance!!!!

Naturalisation Application (Postal) - Return of ILR BRP

Post by liuzhbob » Sun Mar 30, 2014 7:33 pm

I am wondering if anyone would kindly help.

If I send off my original ILR BRP along with my naturalisation application by post, does it get returned to me after my application is approved? Or would the caseworker keep it, as they would normally do to other types of visa application, on the assumption that ILR is replaced by Citizenship hence cease to be valid?

Many thanks!!

Your BRP gets sent back to you along with all other supporting documents expect Life in the UK test certificate, the HO will not send back your LITUK test certificate.

Hi, I was told earlier that its easy to change names once your naturalized bu using deed poll. Before naturlisation, your are not British and other countries may have different process of changing names. For example, In India, its bit complicated as you are expected to post advertisements in a daily paper both at local address and permanent address (as in passport) and apply for a new passport (non-british). Then, you need to get a VISA stamp change as your current passport and visa (on old passport) have different names...

Were as if your are British (post naturalisation) a deed poll is all needed to change the name.

pls correct me if I'm wrong...

Cheers

Hi,
I have few questions regarding my citizenship application. I received my ILR in May 2013 on basis of 2 year spouse visa FLR(M). My husband is on ILR and has submitted his citizenship application in February 2014 via NCS and waiting for approval. He asked NCS about my citizenship application. NCS told that I should apply once my husband gets Naturalization Certificate. Then I can apply as wife of British Citizen.
My 3 years will be completed in May 2014 and I want to prepare for my application. Below are my questions:

1- English Language Requirement: In my ILR application I submitted my Master Degree which is from Non-English country + A letter from my university stating that Degree is taught in English + UKBA website Calculator printout which shows 20 points for education.
My question is that above mentioned documents are enough again for Citizenship application or do I need NARIC approval for my degree? or B1 CEFR?

Asking on NCA they told same documents on which basis I qualified for ILR are enough this time again. I checked UKBA calculator recently and its giving me same 20 points again. So my degree is valid. I just need to confirm that what should I do.. Same ILR docs or NARIC certificate or B1CRFR?

Date of application and being present 5 years ago

Post by madhuraj » Tue Apr 01, 2014 1:17 pm

Hello all,

I am planning to make an application for Naturalisation through NCS on 3rd April, that is in two days.

I assume after checking the documents, NCS will send my application and it will be received by UKBA on 4th April 2014.

Now, the problem is that exactly five years before i.e. on 4th April 2009, I left the UK for a three day trip to France and came back on the 6th April 2009.

While calculating the total number of days of absence, the Guidance suggests that we should exclude the day of departure and the day of arrival, which basically UKBA deems that you are present in the UK on the day of departure so in my case, I should be safe.

My application will be received by UKBA on 4th April 2014 and exactly 5 years before that day, I was present in the UK but left on the day to go to France.

Will it be ok or rather than taking chances I should just postpone sending my application.

I cannot cancel or reschedule my NCS appointment now so I am not sure what to do.

Please can someone help.

Many thanks in advance.

Anything can happen and HO may receive your application 2-3 days later which would disqualify you. If have waited many years few days should not make difference...in my opinion.

Hullo friends, I will be applying for my naturisation in May next month I got a letter today from uk naric saying level of English for the above degree course is considered to meet the requirements of CEFR level 1 and then she put on additional information saying final certificate not presented, the individual sh'd present a copy of the final degree certificate as official confirmation of graduation. Now will that be alright with my naturisation process as concerns homeoffice. Thank you

What documents did you sent to NARIC to get the NARIC assessment done? My assumption is that those set of docs should suffice for your application.

Transcripts, letter from the degree awarding institution etc plus the NARIC assessment you mentioned should suffice but you might have to explain why you don't have your final certificate.

What happened was I graduated but didn't wait for my final certificate as I had to come over to uk but my sister went to that university for my transcript and testimony and sent them to me here in the uk. So that's what I sent to uk naric, now uk naric has said it meets CEFR 1 but that additional inf is the one worrying me

I kind of have a feeling the Transcript, Degree Testimony and the NARIC doc should do the trick with the reason you detailed above. Make sure the contact details of your Uni shows on these docs. If you are using NCS, you might get push back from them, so go there with the aim of convincing them to accept the docs for English language requirements. I don't see any issue at all.

When l called uk naric they said it would be alright with homeoffice as all they need is the English assessment which they have confirmed on their letter that degree meets the meets the English requirement but that additional inf is my problem if you get a case worker who will make it an issue

Be at peace tara70, don't worry too much about it. If you need to pay more the HO will be in touch.

If you send it through NCS, they photocopy everything for you and return originals so you can always keep your original LIUK test report. I wonder why people don't use NCS!

I wouldn't worry much if I was in your place as it probably means that a decision has been made and a letter is on the way. The worst case scenario is that HO may require additional documents from you.
