Returning my ILR card if approved for BC and BP ?

Hi there,

I'm new to the network and this forum was introduced to me by a friend of mine.

I have a question:

Currently, I'm holding an ILR status and therefore I'm applying for British Citizenship and after that for a British passport.

1) If I have been approved for BC and BP, do I have to return my ILR to HO?
2) How long does it take to get decision for BC?
3) whilst waiting for the decision, can I travel outside the UK?

Yes, you have to return the ILR BRP within 5 days after your citizenship ceremony.
2) How long does it take to get decision for BC?
Usually anywhere between 8 weeks and 6 months, something longer.
3) whilst waiting for the decision, can I travel outside the UK?
You are free to travel. You are only British once you have attended the ceremony.

Hi there,

This is the second time I'm writing in this forum and I have found highly useful advices sofar.

I'm completing my nationalism application and in it, it has asked: "Have you previously been married or in a civil partnership?"

I have been into a relationship in the UK and I got a visa for it which enabled my 10-year lawful residence and lead to my ILR based on the long residence route. Nevertheless, the leave I obtained as the result of my relationship was based on "unmarried partners"

1) so I need to know the relationship I had is considered marriage or civil partnership? do I have to mention in the application in this section?

2) also do I need to introduce immigrationboards as my immigration advisor in the application?

No an unmarried partner is NOT the same as a marriage or civil partnership. No need to declare an unmarried partner relationship.
2) also do I need to introduce immigrationboards as my immigration advisor in the application?

Different. The unmarried partner of a British citizen cannot benefit from Section 6(2).

Also, I would like to add something here.

Assuming unmarried partner but British Citizen.

The online form asks about the nationality of the partner. Once you input “British”, the form automatically assumes that one is applying via Section 6(2) and generates the checklist accordingly which asks about the “marriage certificate” and “British passport proof of the partner.”

As Vinny said,
The unmarried partner of a British citizen cannot benefit from Section 6(2).
So for instances like above, one should explain in the cover letter that the application to be considered via Section 6(1) instead.

Personal experience:

I was in a similar situation. Since I am religiously married only, my British wife is considered as an unmarried partner according to British Law.

Since she has dual nationality, I only input Pakistan as her nationality so the checklist generated is correct for my circumstance.

Also, I explained the situation regarding her nationality in the cover letter and mentioned that the application to be considered via Section 6(1) instead as I do not qualify for Section 6(2).

Wanted to share as the above might be your case also when you encounter the form/checklist.

PS you will have to fulfil all Section 6(1) requirements.

Hi there,

This time I have a question about my Iranian passport:

My Iranian passport has just recently been expired (two days ago). If I want to renew it, It takes a good 6 mouth due to covid-19 disruption.

1)If I submit an expired passport with my application, will cause any problem?

I'm actually very anxious, I must not gamble it. :shock: :? :cry:

I'm seeking some serious legal aid, but for now, thank you so much.
