As far as my knowledge is concerned once you submit the application and its under consideration its not class as an overstay

There was an gap issue happened in 2007, it turned my ILR application down in 2013 which was initially refused due to such a gap of 89 days. I had solicitor submitted reconsideration based on the ground of that the refusal was unlawful: compounded results of the followings:

back to 2007, HO office posted my application back to the wrong address----this caused my have only a week to lodge a new application which was in time before visa expired.

Then there were a three further documents requests until the it was sorted out. the 89 days above I mentioned is calculated from last visa expiry date to new visa start date.

My Solicitor challenged that the first refusal was unlawful, the gap is within 28days and ask a discretion reconsideration.

The outcome was that ILR being granted. My take is that HO accepted this gap.

Naively I thought after 12 month, application of Naturalisation would be a straightforward case since I have no other concerns of conviction or what so ever. So I submitted my naturalisation application myself and it seems joined queue after received acknowledge letter two month ago.

The thought troubles me is: under the tightened good character requirement, certainly the drama I explained happened in 2007 will show up on the system as an overstay, will it lead to an automatic rejection?

I think HO case work will go through the material that my solicitor provided and can I hold hope towards that a senior case work (very likely to be handed to) will take a look of the case? such like how the ILR was granted and base on what ground it was granted given the fact of that gap?

I now slightly feel regret to not consult it with the same solicitor who was very helpful with the ILR and I am prepare for the worst but hope for the best outcome :roll:

Hi Guys

Want to seek your viewpoint on my situation and advice if possible.

I submitted AN forms for myself and wife and MN1 forms for our two minor children on 30th April 2015 using NCS Nottingham. The application was accepted by NCS Nottingham which means that we met the requirements of British citizen application requirements. Our applications were received by Home Office on 5th May 2015; I got the confirmation by checking the Royal Mail Tracking System. I provided my credit card details for deduction of fee for these applications. I was Tier 2 a (G) immigrant and granted ILR last year.

On 28th May I received an acknowledgement email from the UK Visa & Immigration whereby I was given a case ID, and as of today no fee has been deducted and no letter for biometrics has been received. It is almost 6 weeks, it is normal?

Moreover, no case ID has been informed for my wife and our two minor kids! Is that because our application has been considered as one family application? Again, is that normal?

Any advice what next step should I take? Many thanks.

Kadd----I have written something about this Topic on "Gaps"or illegal stay within your 10 years.
Read October Naturalisation timeline 2014,thread or page 40 by Kadd.
I had a Gap of 15 months i.e 450 days of what they now, term as "illegal stay" but I had my naturalisation ceremony on the 10/06/2015.
I just think, it would be foolish and unreasonable, for the Home Office to turn down your naturalisation application,based on a mistake they made,and later corrected during your ILR----only, to come back and haunt you with it.

It seems that the time scale now has extended. I'm not sure is using NCS slows the process down, but people sending applications privately have quicker response times.

Hi Wioleta

I too am a Polish citizen hoping to submit my citizenship application in September. I initially arrived in the UK in September 2009, therefore I would only have the required 6 years in September 2015. I have a few queries I was hoping you can assist me with:
1. Have you been in the UK for much longer than 6 years or are you close to the limit? i.e. is it better for me to wait another year/few months before I apply or once I'm over 6 years, that should be enough;
2. Have you sat your 'Life in the UK' test before you reached the required 6 years, if not, are you aware whether it is possible to do so in advance?

I would be grateful if you shared your experience with a fellow applicant-to-be. I wouldn't want my application to be refused on the basis I haven't met the required length by a small margin, equally though I'm eager to submit ASAP given Cameron's latest EU news... (I haven't figured out how to send private messages here, if at all possible)

Hi Mina,

I have been in the UK since November 2004, so 10 years gone in November,but because of changing situation in the UK, I have decided to apply for naturalisation.
I sat my exam 1-2 weeks before I have sent my application.
It was really easy,if you have practised a bit, personally I remembered more from reading the book than practice tests.
I've made calls the HO helpline when had any doubts. Some advisers were more helpful than others, but overall answered my questions.
I think that you have to count 6 years since exercising treaty rights, not the date you arrived.
I hope I've made some sense.

An interesting update, I got a letter in the post (dated 12-Jun-2015) asking me to return one of my passports. The letter stated that the passport is required to prove to the Secretary of State of my residency between 2010 to 2012.

I find that period kinda odd because I got my work permit in 2009 which expired in 2014 :roll: Ahh, well let the waiting begin :?

I was giving till 6th of July 2015 to return the documents. I also must add the I didn't use NCS and requested my documents back once I found out they are going to take ages.
