Naturalisation application

Hello there, Can anyone please help me I have applied for my naturalisations in sep 2021 and I got reply on 4th of feb 2022 -
We aim to process all applications within 6 months from the date submitted. However, in certain circumstances this target is not possible. Following our assessment of your case, unfortunately it appears your application will not be processed within the 6 month target.

This is because your application raises exceptionally complex issues and we require further time to consider your case thoroughly and reach a decision.

We expect to make a decision on your application by date, but we will write to you again if this is not going to be possible.

This is a standard email reported by many members. It's basically saying they may not meet their 6 months target for completion. The bit about "complex case" baffles many applicants but it seems meaningless. Even if you call you won't be talking to caseworkers.

Application date : 8th oct 2021
Biometrics: 1st Nov 2021
Complex issue email on 29th March 22
Approval: still waiting

I am also waiting for the decision - it’s been more than 6 months now.

Unfortunately there's no easy way to get any updates or any idea of time scale. We have no insight into UKVI processes. You could try and involve your MP (not a guarantee they can speed up anything), or just keep on waiting.

hello there so i have got another update about my application which is very complicated. i submit my application on 26.08.2021 and i was out of country for 124 days with in 5 years ( when i can be for 450 days) so they are saying don’t met this requirement?

you were not in the UK on the first day of the residential qualifying period
I refer to your application for naturalisation as a British citizen under section 6(1) of the British Nationality Act 1981.
A person applying under this section is expected to have been in the United Kingdom on the actual date 5 years before making the application.
As your application was received in the Home Office on 26 August 2021, you must therefore have been in the United Kingdom on 27 August 2016.
According to your application form you left the United Kingdom on 09 July 2016 and returned on 27 September 2016.
As you were not in the United Kingdom on 27 August 2016 this requirement is not met.
However, if you reply to this email using the address below, we will be able to continue our consideration. Your new application date will be the date that your email is received by the Home Office.
To do this, simply reply to this email using the address nationalityfurtherinformationrequests@homeoffice.gov.uk confirming that you wish to re submit your application.
Failure to reply between these dates will result in your application being refused on the grounds that you do not meet the statutory residence requirements for naturalisation, as you were not in the UK on the first day of the residential qualifying period.

If you do not have official evidence for any period, send other evidence you have to show you were living in the UK. If you don’t have any evidence for a particular year, please tell us what you were doing at the time.

The best evidence to send is official documentation which could include:

evidence of employment such as a P60 tax certificate, salary or wage slips, or a letter from your employer confirming the dates you were employed

letters from the Department of Work and Pensions confirming if you received benefits and the dates you received them

pension statements from HM Revenue and Customs confirming the dates of payment of taxes and National Insurance contributions

Letters from schools, colleges, universities or other public or private establishments confirming that you were enrolled on a course of study or vocational training and the dates you attended


i cant find p60 i can only get for last 3 years.
during june 2016- august 2021 i was outside of country for 124 days
i don’t understand what there mean about this - does it mean i have to do everything again application and fees? or just email and they will count new 5 years? its complicated.

As you were not in the United Kingdom on 27 August 2016 this requirement is not met.

According to your application form you left the United Kingdom on 09 July 2016 and returned on 27 September 2016.
As you were not in the United Kingdom on 27 August 2016 this requirement is not met.
So we're you out of the UK during these dates?

The absence limit is separate to the mandatory requirement to be physically present in the UK at the start of the 5 year qualifying period corresponding exactly with the date you apply for citizenship.

Many people have received the same email asking to reply to resubmit the application. You can browse using the same text and find answers on this website.

It basically means you have to be in uk 5 years ago from the date of application in order to comply with requirements. It is some rule that they calculate on that basis.

Since you were not in uk - they are asking to reply to resubmit the application. I think you will receive your approval soon . Best wishes.

Shall i email them that resubmit my application? or i have to fill new application,
but i thot you are fine if you are out of uk for 450 days not more than that and i was out only 124 days.

Yes,the absence is fine. But it is separate to the mandatory requirement to be physically present in the uk at the start of your qualifying period, so you should not have any absence exactly 5 years before you apply for citizenship.

Do not confuse the two separate requirements.

Yes, that is what you should do. If there is an attachment to resign and date the form,do it and send it back but make sure that the date you resign us a date you were in the UK 5 years ago in 2017.

When I submit my application I had absences of 124 days. From 2016-2021 and still I don’t understand what is going on where I am doing mistake.

When you submitted your application in August last year, the mandatory requirement was that you must have been physically IN the UK exactly 5 years ago in August 2016, IE not abroad on holiday. You apparently were not in the UK as you were abroad between June 2106 and September 2016 and this is the mistake you made when you applied by not checking you met the requirement to be in the UK exactly 5 years earlier.
The mandatory present 5 years ago requirement has no discretion to be waived. This has nothing to do with any absence limits which is a separate and different requirement.
And if I am replying back that please resubmit my application will they count from today’s date back for 5 years?
Yes. But you MUST make sure that you were actually IN the UK on the date you resign in may 2017, ie not out of the UK for any reason.

I was on maternity leave that why I went for holidays. And I thought that’s fine as I am not away for 450 days I will be fine. But I never left uk for good or anything I went to see my parents with there grandchild. That’s all. So if I resubmit will they count from 2017 till now? But still I was away for 37 days. When I submit I read everything and did accordingly this is so confusing for some people.

I understood now I had to read it’s the date effecting not the period.
One thing I want to clear if I ask them to resubmit my application they will count from todays date past 5 years? Am I right. And I don’t have to do anything else they will consider my application. Thanks again

It is not your period or absence limit that is the matter here. It is the requirement to be present in UK 5yrs ago counting from date Of application.

I was on maternity leave that why I went for holidays. And I thought that’s fine as I am not away for 450 days I will be fine. But I never left uk for good or anything I went to see my parents with there grandchild. That’s all. So if I resubmit will they count from 2017 till now? But still I was away for 37 days. When I submit I read everything and did accordingly this is so confusing for some people.
It is not your period or absence limit that is the matter here. It is the requirement to be present in UK 5yrs ago counting from date Of application.
Yes I understood this now I had to read. So if I email them to resubmit the application as they have me option so it’s will be the date from today till may 2017 and they will consider my application. Thanks again

Thank you so much. I am really sorry I took your time. But didn’t want to do anything wrong. It was so confusing and took me while to understand it’s not the gap it’s the date I was not in country so that was the problem so I will ask them to resubmit the application. Will I have to wait again 6+ month as it will be resubmission or they will do it quickly.
