90 days Absence

Post by natsha » Tue Nov 03, 2020 7:21 am

Hi,

1- I was on holiday from 25th Dec to 05 Feb 2020.

2-Now I am on holiday from 05 Oct 2020 to 26 Nov 2020 (due to lockdown stuck)

My question If I apply for my British citizen application on the 1st of Jan 2021 so From 1 Jan 2020 to 31 Dec 2020 can I calculate 90days?

Also, I must be present in the UK to the start of 12? IF I start my last 12 months from 1 Jan 2020 I was not present in the UK.

Regards,

90 days in the 12 months immediately preceding date of application.

There is no requirement to be physically present 12 months before applying.

The physical presence requirement is mandatory for the start of the 5 year qualifying period, ie date of application exactly 5 years ago or 3 years ago if applying based on spouse of British citizen.

1. Date if application is the date you submit and pay, which is done at the same time. You can't submit and then pay on a later date.

It is about 90 days ABSENCE and not staying in the UK for 90 days.

2. Fine.

3. 3rd to 5th Jan 2016 to be on the safe side.

4. Fine as long as he is registered with the relevant professional body

1. Last 5 years.

2. Yes.

3. It is not physical present 12 months before applying. You need to have been physically present at the start of the 5vyear qualifying period, so January 2016.

Assuming you are applying in your own right and NOT married to a British Citizen. Assuming you apply on 20th Jan 2021.

Your qualifying period:

You need to list absences during the following 5 years.

21 Jan 2016 - 20th Jan 2021 (5 years)

You must be in UK on 21st Jan 2016

Not outside UK for more than 450 days in the above 5 years.

Not outside UK for more then 90 days between:

21st Jan 2020 - 20th Jan 2021.

There is NO requirement to be in UK on 21st Jan 2020.

Yes, provide the details requested - the location where you got married is not an issue. I don't believe a marriage as such doesn't need to be registered in the UK.

Marriage done abroad as per that country’s law and registered in that country, is also recognised in UK. If your partner is not British, it has no impact on the AN application due to this question. Just mention the actual details as such.

A Couple Of Questions, please

1-which Tax office reference number for the limited company (For Director) I need to PUT.

*Employer PAYE reference
*Self Assessment Unique Taxpayer Reference
*Corporation Tax Unique Taxpayer Reference

2-Previous Employee Has British passport can I used him as Referee?

Thanks
1) Employer PAYE ref.

2) If he meets the criteria as per the Adult referee criteria, then yes.
For an adult application, one referee should be a person of any nationality who has professional standing, eg minister of religion, civil servant, or a member of a professional body e.g. accountant or solicitor (who is not representing you with this application).
For all applications, the second referee must normally be the holder of a British citizen passport and either a professional person or over the age of 25.

1. LITUK/English ok
2. Passports only required for last five years
3. BRP only needed
4. Referees OK
5. Not sure what that is (ILR related?) - but not something required for naturalisation.
6. "Good character" No proof required unless you need to disclose issues with that.
7. Cover letter not required - unless you wish to explain something in more detail.
