UKM Application

Good Evening,

I'm hoping to get some advice.

My Mom was born in Northern Rhodesia in 1950. Her Dad was born in 1926 in South Africa but moved to Northern Rhodesia.

At this time they were still classed as a British Overseas Territory.

My Mom got her British passport from her Dad.

I was born in 1975 and at the time of my birth, she was still a British Citizen.

The question is ...

Can I apply using the UKM Route ? This would be double descent. If approved can my Daughter be included ?

That’s three generations born outside UK , and it seems unlikely . The UKM route has a birth in UK (not colony) requirement. Please see:

I was told that I could apply by double descent. They are classed as British Overseas Citizens.

I was hoping to apply this route as its not so expensive. An Agency says they can help me but the rates are very high.

Please read Guide UKM . You should be able to point out the categories you qualify under , or what disqualifies you . Since you’re attempting to save on the application, it’s a worthwhile exercise.

There are specific rules associated with this route, including birth within UK, and right of abode . British Overseas Citizens did not have right of abode .

Form UKM is only for claiming full British citizenship if the mother had full British citizenship at the time of the applicant's birth, before 1983.

It cannot be used to claim British Overseas Citizenship or any other form of British nationality.

My Mom has a full British passport at the time of my birth. I was born in 1975.

Her passport says British subject. She got her passport through her Dad. So I should be able to do this by double descent.

The agency wants to charge me £400 but this application is £80.

In order to apply on Form UKM, you need the Right of Abode in the UK. That is only possible if either you, one of your parents or either one of their parents was born in the UK as currently constituted. Was that the case?

The children of British Overseas Citizens or any form of British nationality other than British citizenship cannot use the Form UKM to acquire British nationality. It is only specific to people who have (or would have had) Right of Abode in the UK.

My Mom's Grandpa was born in Beverley, England. That's how my Grandad and my Mom received their British passport.

Your mother would have had the Right of Abode, because her grandfather was born in the UK.

However, you would not have the Right of Abode (which is a requirement for applications under Form UKM), as none of your own grandparents were born in the UK.

OP also mentions that her mother and grandfather had British Overseas Citizen passports which suggests her mother had CUKC with no right of abode . Either way the OP does not either so UKM route would not be available .
