I m 100% sure they are covered under s.3c if applied in time.

How can this period is qualifying residency for ILR (10 yr long residency) but not qualifying for naturalisation ?

Where to go now Solicitor or MP ?
A quick question, as you mention extension & appeal (12 months) I presume the initial extension application was refused with the right to appeal, is this correct? If so was the appeal submitted within the stipulated time period?
Applied in time
Application refused
Appealed in time

Above time was Not problem for ILR how it's problem now for natrualisation
I can not see in problem in ur circumstances. I dont think so that is considered as an overstay. In my openion that is a silly mistake on HO's end, it should be fine in recosideration if it goes in competent hands.

UKVI incompetence at its best and nodoby can do anything about it, HO is a king of this kingdom. we can only sit, clap n moan on this forum.

Based on the information you've provided it does appear that the reason for refusal is invalid. I've just re-read the s3c guidance as well...

https://www.gov.uk/government/uploads/s ... _0_EXT.pdf

As the previous poster has also suggested what I'd do is request a reconsideration (as there is no appeals process for naturalisation) by following the procedure outlined by the HO.

Another example of HO compentency

My friend has called HO today to get an update on his application which was under consideration and enquire about the acknowledgement letter as he hasnt received one.

Customer service advisor told him that there r 4 stages of the applications till decision and he did not mention the stages but the info through FOI has mentioned that there r 2 stages of the application. I dont know who to beleive.

Most interesting thing is when he asked them to comfirm his address then he came to know that HO has one of his previous addresses as his currect address where he use to live 4 years ago and he changed couple of address after that. He has been advised to fill in the change of circumstances form.

He called them and came to know that HO has got his wrong address, so all posts must have gone to the wrong address. What if he did not call HO?

Those bunch of incompentent people r not doing correct data entry, not taking decisions according to the law, not dealing with application in timely manner and not following any pattern of work. I thought that HO is just picking up applications randomly but I did not think that they r picking up address randomly too n putting it as applicants current address. that is ridiculous

How many people are going / have been affected by the new good character requirements like section 9.7. & has anybody heard of any reconsiderations that have been successful?
9.7 Evasion of immigration control
The decision maker will normally refuse an application if within the 10 years
preceding the application the person has not been compliant with immigration
requirements, including but not limited to having:
a. failed to report
b. failed to comply with any conditions imposed under the Immigration Acts
c. been detected working in the UK without permission

Hello friends. I need some help. My naturalisation application has been refused as the letter says I used deception in 2008 to get student visa.I want to send it for reconsideration. Can someone suggest me a good immigration solicitor who can deal with this.

Thanks for the reply but as I asked in my previous post, I am looking for any suggestions regarding a good solicitor and not to discuss my case in this forum. If you can suggest, I would be grateful.

Search for immigration solicitors online and you'll find many

Don't know where you are but
Marks & Marks and Malik & Malik
Both are in London and I have tried both. They are very good.

Please help me!

I've been refused citizenship on character. And the reason given was because I entered my country of birth with my Travel document when I should not have.
Does anyone know of someone who has successfully appealed this?

Please help

Hi Siraj,

Thank you for replying.

Basically the home office has said that I have used my Travel document to visit my country of birth when it said on the TD that I shouldn't. There fore I do not meet the good character required .

I have just found out that there is precedent In my case. And most have been successful. Apart from that I meet everything else.

Did you qualify ILR under asylum and a caveat was not to return to your home country? What was the actual basis of refusal? I'm intrigued how they explained that to marry up their guidelines.

I have broken immigration rules by visiting my country of birth for 220 days in 25 years of residing in the UK of which I 've had ILR since 1999. Also this was my only time to have left the UK shores since setting feet here.

I cannot believe this is a basis for judging good character..... ridiculous!!!

I've not much knowledge into this matter, my apologies.

If you have had ILR in 1999 then why didn't you apply in early 2000?

Hi Warren or anyone who has answers to this,

Firstly many congratulations to your successful reconsideration in less than a month! It will be fantastic if you can give a little insight. Could you advise how you got MP involved please? I submitted my reconsideration in February 2015 and still waiting. Two other people who did the same in this thread waited for seven months and I really don't want to wait that long. Did you write to the MP first or visit him/her in the office directly? Did the MP call the Home Office to chase it up for you? Which department of Home Office and what number did you provide with the MP please? Thank you in advance for your help!

#Tracey.
You will need to find out when and where you local MP holds his/her monthly surgery. Take the home office letter with you and they will do the rest.
