It looks like his status was student from 2004-2007 and he did not pay any Tax during that period neither he claimed any benefit. My assumption is he received his PSW in 2008 and then started paying Taxes as he mentioned in his post that he is paying high taxes since 2008. He said he was asked to send P45 or P60, which means they wanted to know if he was working on below tax threshold then he must have P60 or P45. They probably could not find his record from HMRC. This is an example of extreme scrutiny of someone's history.
One thing I can tell you sure that the employers don't send them details of numbers of hours worked. They only send how much you earned in that financial year. Before they had option to send yearly tax but I think now they have to send them monthly details of employees. Before employers used to submit details of their employees at the end of financial year to keep the money with them for long period..

No my assumptions are different. As per my little research/understanding they only ask about how you maintain yourself for the period when you overstayed to get you yourself admitted that you were working although they have your bank statements showing funds which you attached when student extension in past. I believe we should wait for reply from mshafique. Moreover, I am also trying to get it fully enquired from nationality policy team and once get reply will share in a new thread.

People when you have been refused....how long did you refusal take from date of you applying??

You seem to be worrying for no reason :wink: . I noticed that you applied under spouse of BC category, which is generally a straightforward process unless you have criminal convictions, previous overstay, illegal working etc.

Im not worried about that. im worried because the acknowledgement letter says on it ' Type of Application; AN6(1)
and not an6(2)

AN6(1) is for those applying NOT as the spouse of a BC...ie, students, Tier 2,3,4 andso on...
NCS lady seems to think they just sent the wrong standard letter

I thought it would be obvious since my marriage certificate and wifes passport is there too!! who knows!

My case will be decided on AN6(2) and it was clerical error on the letter

"Read it somewhere"? Not necessarily. They may not have even started to process your wife's application yet, especially with the start of the Summer holidays with reduced numbers of staff.

Hi There,

i am about for apply for naturalization on the basis of 5 years work and 1 yr ILR. But as per the new May 2015 form, we have to disclose the employment history for last 10 years. I was student before 6 years and have worked part time in sales roles here and there. Do I have to declare that as well ? If yes, will it affect my application ?

Also if my application is rejected for some reason, can HO cancel my ILR ?

Please advise.

Why would HO cancel your ILR ?? , ILR is different thing and Nationality is different, they wont cancel your ILR if they reject you nationality application. dont worry unnecessarily.

Hi

shoebyunus ask valid question, if they ban you for 10 years on goodcharacter ground like working illegal or without authorization, then they can revoke your ILR too according to Paragraph 321 A for revoke of ILR they can revoke it for false representation or concealing facts in ILR application ??? any expert opinion ???

ILR can be revoked, it depends from case to case. If leave was granted using deception then it can be revoked as far as I know. Even if someone becomes a British Citizen they can also be deported under new law.

Yes, see Q23. Depends if it was deliberate or not too, but you should pay back whatever you weren't supposed to get. One of the checks they do is with the Department for Work and Pensions.

hi guys .as I was expected I received my refusal letter today . I apply in the end of January . used ncs who they called the ho ,the adviser told the lady at ncs that I can apply if I can prove some extra papers mainly about my wife , any way the reason were 2 things boths were not realy true
1- been illegal for 5 years ,that was not true as I claimed asylum seeker on the first day and my application was refused after 3 years so I was illegally for 2 years not 5 and they never menschen that I claimed asylum on my arrival and I was offered a temporary stay the adviser on phone with ncs was aware about this and said u can apply
2- I provided with documents clearly show I was working illegally( never said when or wish period) . not true and I think they talking about the period when I apply for residence card (they give me a letter state that I can work wile my application on progress and im legaly now so I find job one week after I received the latter) and the date when I received my residence card that was 11 months later .
any advise please

I have a question. My husband came to this country on student visa in 2002.He got his work permit in 2007 and worked for that company for 1 year. Then he switched after a year to the new job and worked till 2011 ( 3 years) for that company but didn't inform home office about change of his job because his new company was not ready for apply his work permit. He sort of illegally working for that period of time. After that he switched to my dependent visa (for last 4 years) and secure his ILR on 10 year basis last year August.
My question is he wants to apply for British citizenship, but with the new checks about 10 year employment records what are the chances that he will get caught ? if he would , is there any danger to his PR status and also my son british nationality>>
I am on tier 2 now and would apply for PR March 2016.

Please help??

Where is AN6(1) / AN6(2) defined etc. ?

Edit: Never mind. In case someone else ends up here via search.

AN6(1) and AN6(2) is what people refer to as the section of the British Nationality Act from 1981 ...

Hi guys,
First of all congrats to all fortunate enough to get their BC without PR. Unfortunately my case isn't so lucky and I have just received a letter refusing my application.
I'm a Slovak national, living in London almost 11 years, working full time all these years and got my BA degree in the process too. I applied in mid February through NCS, in June I received a letter asking me to provide evidence that I have spent 12months working for the same employer since registering with WRS back in 2005. I never even thought they'd be looking so far back and expected them to look at past 6 years, not the bery beginning of my journey in UK. I remember registering with recruitment agency but 1 week after I received my WRS card I changed jobs and failed to register again (wasn't aware that I had to register with every new employer), even though I then spent 3 years and 2 months working for that employer. I provided my P60s from 2005-2007 as well as p45 from that employer when I left them, plus almost all payslips from that period proving I was working for them.
In the letter I received it says my apllication has been refused due to my not excercising the treaty rights for continuous 5 years. As mentioned, I have lived in London for over 10years, paying taxes, no fines/tickets, convictions.
Does anyone have similar experience? What action do you suggest? I'm absolutely gutted and very disappointed to say the least!
