Update to the Good Character Requirement in Nationality Applications

Post by DJay77 » Sun Oct 01, 2023 3:46 pm

Hi Guys,
The update to the good character requirements states:

A person must be refused if they have:
• a custodial sentence of less than 12 months
• a non-custodial sentence or out-of-court disposal recorded on their criminal record
and you are not satisfied, on the balance of probabilities, that they are of good
character.

Unfortunately I had a custodial sentence of 8months in October 2013 (served 3months) concurrently for 2 charges of false representation and 3points on my driving license for speeding in August 2023.

Under the old requirements, I would be eligible to apply for naturalisation in June 2024, with the new requirements, I’m not sure when I can apply or if I can apply? I’m hoping someone will be able to advice me on what to do.

Thanks.

I have moved your post to your own topic. Tagging questions onto another member's thread is not only confusing, it's also unfair to the original poster.
(Casa, not CR001)
Please don't send me PMs asking for immigration advice on posts that are on the open forum. If I haven't responded there, it's because I don't have the answer. I'm a moderator, not a legal professional.

I trust that under the new rules you should be able to apply. You need to show that you have improved your character since your sentence. But the new rules says clearly that you won't automatically be rejected.
