British Passport - on hold - for my daughter

Can you please help me with the situation below?

- My daughter (Name A) is born in India and entered UK as Tier 1 dependant. She then acquired ILR. She has been granted British citizenship recently on the original name A.

I had intentions of changing my daughter's name. I did check with Passport office whether I can apply for British Passport on my new name along with deed poll, customer care executive said I can.

Last week I have changed her name to B using UK deed poll.

Hence I applied for British Passport using following:
- Original Indian Passport (Name A)
- Naturalisation Certificate (Name A)
- UK deed poll (name change from A to B)
- Passport application form (Name B)

Today I received a letter that Passport office cannot issue a birth certificate for my daughter since Indian passport doesn't have new name (i.e. B) on it.

Two months ago, when my wife visited India she got the Indian birth certificate amended to Name B. At that time we did not change the passport as its a lengthy process (advertising in news paper etc)

Now, if I send the new Indian birth certificate then will it do the trick?

Can you please add your input as I'm utterly confused.

Experience on these forums have suggested that advice given by Home Office advice lines is not only not accurate, they are also not bound to follow the incorrect advice they have given you. You are far better off googling for the answer.

A quick Google search for "passport name policy" takes you to the HM Passport Office: passports policy page. Go through the relevant policies that could apply to your daughter.

The Home Office has a well-known policy of not allowing a passport to be issued in a different name from those on other passports, to combat fraud and/or other international crimes.

There is a thread on these forums about people who have changed their name in middle of undergoing the naturalisation process and ending up in the same situation as your daughter. You may want to go through that forum and find out the solution.

Having tried to avoid wasting time getting an Indian passport in her new name, you will now need to spend much more time and money in getting a British passport in her new name. And while she has no passport, she can not travel.

After going through the links you have provided, I think I have 2 options:

Option 1:
Send the new Indian Birth certificate(which we luckily have now) to Passport office along with covering letter to consider new name.

Option 2:
Send a letter to Passport Office requesting them to issue passport on old name (A), later after receiving the passport then I can re-apply for new passport with new name (B) using 'change of details'. UK deed poll document should support the name change.

I'm not sure whether I can even apply for change of Indian passport as India doesn't support dual nationality as my daughter now has British Citizenship.

I really hate the process involved in applying for change of details in Indian passport.

Do you think above options make sense?

I agree with what moderator said,
The least cumbersome, though expensive by £75, process:
1. Get British passport in the same name as Indian passport.
2. Surrender Indian passport.
3. Apply for new British passport under the new name.
4. Apply for OCI under new name, include both (old name and new name) British passports and deed poll.

B my main worry is that what if Passport office doesn't approve and insist on issuing a passport on new name.

Makes sense but Option 1 is unlikely to succeed as it doesn't address the 'other' identity (as HMPO sees it) as manifested in original passport.

For the subsequent passport 'renewal' in Option 2 to succeed the original passport will have to have been cancelled/surrendered.

Right,the process for option 2 may be as follows
1. Get british passport on old name
2. Surrender Indian passport
3. Re-apply for british passport on new name

My main worry in this case is whether Passport Office will be willing to issue passport atleast on old name now since they already have a deed poll which I sent.

You may be asked for a letter to declare which name is to be used, for all purposes, from now on.
Some members have reported that HMPO have taken such an approach.
