BRP to BC by naturalisation

Hi all,

I aquired a BRP few weeks ago via my EU spouse who is also a BC. I read a Non-EU spouse could apply for BC by Naturalisation immediately after aquiring Permanent residency without having to wait for 12 months with is an EU regulation I guess.

I need a bit of clarity before submitting an application;

Is this rule only applicable to Non-EU citizens that have always been on Immigration Rules or is this available to Non-EU nationals that have been resident based on EEA Regulations?

I am a bit confused as my spouse aquired BC before I submitted an application for Permanent residency although it was subsequently granted I want to know if I can rely on my spouse being a BC now to apply under the 3 years Immigration rule rather than waiting for 12 more months.

Yes you can rely on your spouse being BC - 3 year rule, as long as you can meet all the requirements. You still need PR but you don't have to wait 12 months. For naturalisation there is no different treatment EU v non-EU.

Thanks for your response. Do you have an idea how I can find out the deemed date of aquiring Permanet Residency? This information was completely missing from my decision letter.
