Can I apply as a depandant? ... help pls

Can I apply as a depandant? ... help pls

Hi there,

I'm legally in the UK as a dependant (my wife is on the post study permit). Can I apply for the Tier 1 instead of her since she is not making enough money?
(I studied and work in the UK).

i just checked the list of those eligible to apply on the UK Border website, and nothing was said about dependants applying.

Yes, if you qualify for it! Read Tier 1 (General) policy guidance.

But you cannot change your immigration status from dependent of Tier 1 (PSW) to a Tier 1 (General) migrant from within the UK. You'll have to return to your home country and apply there.
